Hearing Action Taken ----'-�-�- Applicant's Signature BOZEMAN CITY ZONING COMMISSION STAFF REPORT ITEM: Minor P.U.D. of Lot 6, LeClair Subdivision APPLICANT: FIRSTCO DATE: June 4 , 1984 REPORT BY: Steve Lere, Planning Director LOCATION/DESCRIPTION The proposed Minor Planned Unit Development is located on Lot - 6 of the LeClair Subdivision, at the south end of the cul-de-sac of South 18th Avenue. Please refer to the location map. In * WEST MAN STREET 8A COCK STREET u 0 i STREET t �I The project site is approximately 26, 000 square feet in size and will consist of 2 four-plex units. The area is now zoned R-3 , medium density residential , which allows up to four units on a lot without going through the PUD process. Access to the property will be from the cul-de-sac on South 18th Avenue. 2. 18 Off-street parking spaces are required; 18 are being provided . 3. The proposal will consist of 2 structures with four 2 bedroom units. STAFF COMMENTS As a result of the Staff ' s review, the Staff has the following comments. Chapter 18 . 75 . 040-10 requires fire hydrants, and connections be installed for fire protection of the proposed development. This information will need to be approved by the Bozeman Fire Chief. The City of Bozeman now requires sidewalks along all public rights-of-way to access developments. A sidewalk will need to be shown along the cul-de-sac of South 18th Avenue that fronts the property. Plans for sewer and water connection will need to be reviewed and approved by the City Engineering Officer. Drainage Plans will need to be reviewed and approved by the City Engineering Officer . STAFF FINDINGS As a result of the Staff ' s review, the Staff has determined that the project is in general compliance with the goals and intentions of the Bozeman Area Master Plan and Zoning Regulations. The Planning Staff suggests that the application for a minor P.U.D. be approved contingent on the applicant satisfying the following conditions. 1. That fire hydrant location be reviewed and approved by the Fire Chief and the City Engineering Officer for assurance of adequate fire protection . 2. That a sidewalk to City standards be installed along the property boundary that fronts South 18th Avenue. 3. That sewer and water hookups are reviewed and approved by the City Engineering Officer . 4. That the developer enter into an improvements agreement with the City of Bozeman. If occupancy is to occur prior . to the installation of all scheduled improve- ments, the developer shall provide a method of security equal to one and one-half (1-1/2 ) times the estimated cost of the remaining improvements. Said agreement i shall include detailed plans and specifications of all improvements, cost estimates, and final site plans. 7. That three (3 ) copies of the final site plan containing all the conditions, corrections and modifications approved by the City Commission be submitted for review and approved by the Planning Director within six (6) months of the date of the City Commission approval and prior to issuance of a building permit for the project. One (1) signed copy shall be retained by the Building Department, one (1) signed copy shall be retained by the Planning Director , and one (1) signed copy shall be retained by the applicant. 8. All on-site improvements ( i.e. , paving , landscaping, etc. ) shall be completed witin eighteen (18) months of the approval of the conditional use permit as shown on the approved final site plan. 9. The conditional use permit shall be valid for a period of only eighteen (18) months following approval of the use. Prior to the permanent renewal of the permit at the end of that period, the applicant must satisfy all the conditions in the granting of the permit. An on- site inspection will be made, and a report will be made to the City Commission for their action. Drenk: In reviewing our files, it has come to our attention that the time frame for completion of the eight . (8) unit Minor Planned Unit Development located on Lot 6 of the LeClair Subdivision expires on December 11 , 1985 : However , Letter of Credit No. 0062 , issued by First .Bank Bozeman , and submitted to secure site improvements expires on October 19, 1985 . The Planning Staff recently reviewed the site and we have identified the following improvements which must be completed prior to issuance of the Conditional .Use Permit and release of the Letter of Credit: 1 . Construction of the curbing around the landscaped area on the southeast portion of the lot; 2. Construction of the sidewalk directly north of the parking area; 3 . Completion of the construction of the garbage enclosure; and 4 . Completion of the installation of the landscaping, including the seeding or sodding of the lawn areas. It is the intent of this letter to make you aware of the improvements which must be completed prior to issuance of the Conditional Use Permit and of the relevant time frames. We would encourage you to complete these remaining items so that we may release the Letter of Credit . If you have any questions, please feel free to contact Steve Lere or myself. OF LOT 6 LeCLAIR SUBDIVISION This Agreement,' made and entered into this llth day of June, 1984 , by and between FIRSTCO, hereinafter called the VI "Developer" , and the City of Bozeman, County of Gallatin, State of Montana, acting by and through the Director of Public Service for the City of Bozeman, hereinafter called the "Director'" . WHEREAS, it is the intent and purpose of both the Developer and the Director to hereby enter into an agreement which will guarantee the full and satisfactory completion of all improve- ments within the development hereinafter described and by this Agreement to satisfy the improvement guarantee condition for the Minor Planned Unit Development. THEREFORE, it is covenanted and agreed as follows : This Agreement pertains to and includes that development which is to be located on Lot 6 of LeClair Subdivision in the City of Bozeman. This Agreement specifically includes the installation of 5, 835 square feet of parking, drainage, curbs and sidewalks, land- scaping, lighting and garbage enclosure, as illustrated on the final site plan, "Exhibit A" . Costs of these improvements are listed on "Exhibit A" All improvements shall be completed and approved by the City prior to occupancy of the structure. If occupancy is to occur prior to the installation of said improvements, the Developer must provide a financial guarantee payable to the City of Bozeman in an amount equal to one and one-half (.11-,) times the estimated cost of 1. 0 construction of any improvements not completed at that time as part of this Agreement, "Exhibit B" . In any event, all improvements shall be completed within eighteen (.18) months of approval of the :Minos Planned Unit Development. Performance by the Developer of the covenants set . out in this Agreement is the essence of this Agreement; accordingly, the Developer expressly understands and agrees that his failure to meet the time schedule described herein shall be deemed to be a. breach of this Agreement. The Developer hereby- waives any notice of breach by him. Upon any breach of this Agreement as herein defined,the Developer shall forfeit the financial guarantee., and .such financial guarantee shall be used by- the City of Bozeman to secure completion and .in.s,pection of the construction described herein. This Agr.eement . shall inure to the benefit of and. be binding upon any, succe.ss_ors in. interest., heir, or assignees. I.N.
