Application Lot 11, LeClair Subdivision Dear Mr. Cowdrey: The Planning Staff has reviewed your submittal for a planned unit development, and find that it is not in accordance with the criteria set forth by the Zoning Code , City of Bozeman, Montana. Therefore, we cannot accept the application as submitted. The proposed P.U.D. is in violation of Article 18. 54. 110 - . Setbacks for Planned Unit Developments. It reads : "No Building or structure, except a wall or fence, shall be located closer to any exterior boundary than eight (8) feet, plus three (3) feet for each additional story over one story. " The plot plan submitted indicates the 8• plex struc� ture penetrates the eleven foot setback (total setback for a two-story structure) , along the southern boundary of the site. In view of a re-submittal, listed below is a list of issues which must also be addressed before it can again. be reviewed. Your attention to the issues should reduce any further delays. (1) Designate the location of existing and/or ' proposed facilities wh_ich .are to be used for- drainage control. Indicate contours of final grade and direction of surface drainage for both open space and parking street area. Include a typical section of screening to be used. (5) Article 18. 54. 160 of the Zoning Code re- quires off-street parking areas not under cover to be screened from view of nearby residences. The issue must be addressed and indicated. on the site plan. Particu- lar attention should be given to the area adjacent to the north edge of the parking area. (6) Additional information should include; (1) total number of each landscaping type; (2) percent of total open space; (3) north arrow; and . (4) designate curb radius and sidewalk with respect to existing cul, de-sac. Particular attention must be directed to the access from the cul-de-sac on South 18th Ave. Although it is not necessary for the interior street to be perpendicular to the cul-det-sac, redesign _is pertinent for effective access to and from the site. WHEREAS, it is the intent and purpose .of both the Deve- loper and the Director to hereby enter into an agreement which will guarantee the full and satisfactory completion of all improve- ments within the Development hereinafter described and by this Agreement to satisfy the improvement guarantee condition for the Minor Planned Unit . Development. THEREFORE, it is covenanted and agreed as follows: This Agreement pertains to and includes that deve- lopment which is to be located- on Lot 11 of LeClair Subdivision in the City of Bozeman.
