Sincerely, o�7Mike Money Senior Planner MM/nh Enclosures I' IMPROVEMENTS AGREEMENT CLAIR DAINES, 6 UNIT RESIDENTIAL PLANNED UNIT DEVELOPMENT This Agreement , made and entered into this day of , : 1984 , by and between Clair Daines, hereinafter called the "Developer" , and the City of Bozeman , hereinafter i called the "City" , County of Gallatin, State of Montana , acting by and through the Director of Public Service for the City of Bozeman, hereinafter called the "Director" . WHEREAS , it is the intent and purpose of both the Developer and the Director to hereby enter into an agreement which will guarantee the full and satisfactory completion of all improvements within the development hereinafter described and by this ' Agreement to satisfy the improvements guarantee conditions for a Conditional Use Permit . THEREFORE, it is covenanted and agreed as follows : This Agreement pertains to and includes that development . which is designated and identified as a 6 unit residential planned unit development located on Lots 1 and 2 of Block 8 of Thompsons 4th Addition to the City of Bozeman . This Agreement specifically includes the construction and inspection of paving of feet of private drive, storm drainage improvements, landscaping and sidewalks. All improvements shall be constructed in accordance with the plans and specifications submitted to and approved by the City of Bozeman prior to construction . Said plans and specifications shall be part of this Agreement "Exhibit A" . All improvements shall be completed by the Developer and approved and accepted by the City of Bozeman prior to 1 i occupancy of the structures . If occupancy is to occur prior to the completion of said improvements, the Developer must provide a financial guarantee payable to the City of Bozeman in an amount equal to one and one-half (1-1/2) times the estimated cost of construction of any improvements not completed at that time as part of ,this Agreement, "Exhibit C" . All improvements shall be completed by the Developer and approved by the City of Bozeman prior to release of all financial guarantees by the City of Bozeman and in any event, all improvements required by this Agreement shall be completed by the Developer prior to July 1st, 1985 . . The cost estimated for said improvements are included as "Exhibit B" of this Agreement . Performance . by the Developer of the covenants set out in this Agreement and in conformance with the time schedule set forth in this Agreement is the 'essence of this Agreement ; accordingly, the Developer expressly understands and agrees that his failure to meet the time schedule described herein shall be deemed to be a breach of this Agreement. The Developer hereby I waives any notice of breach by him. Upon any breach of .this Agreement as herein defined , the Developer shall forfeit the financial guarantee provided with this Agreement in an amount equal to one and one-half ( 1-1/2 ) times the estimated cost of construction , of any uncompleted project and such financial guarantees shall be used by the City of , Bozeman to secure completion and inspection of the construction described herein . This Agreement covers four (4 ) separate projects; storm drainage, paving , landscaping and i sidewalks. Estimated costs of construction for each project are attached hereto and made a part of this Agreement. , As each projec t is completed , the financial guarantees for that project may be released by the City of Bozeman. Daines Inc. 104 Heritage Drive Bozeman, Montana 59715 Dear Clair: This letter is to follow up your submittal for the Minor P.U.D. Project located on Tracy and Carol Place. First I would like to thank you in allowing j us time to complete the review, . The site plan as submitted is incomplete and further information needs to be provided. The information and changes needed are the following. (1) The lot or lots must have their dimensions illustrated and drawn accurately to scalef. (2) 75% of the front yard area along Tracy Avenue must be landscaped. Calculations must be submitted confirming this. (3) An 11 foot setback is required off of the eastern property boundary. The setback and the setback of the building must be. accurately shown. (4) We ask that you confirm the three accesses with Neil Mann, the City Engineering Officer. If it is or has been approved, it is suggested that the entrance and exit be marked accordingly. (5) The site plan shows the snow removal area, but does not address runoff. This information must be provided. Please keep in mind that the water must be treated or .filtered before entering the stream' s system. The plans need to show the method of treatment. (6) Since the runoff will not be allowed to flow north into the creek from the parking area, it will be required that continuous c.urbing be utilized for the parking area. (7) In our conversation, you indicated you may want to put a garage up in the parking area. This needs to be shown on the Plans. For security reasons, I suggest locating the building in the northern corner of the parking area. This will make most of the parking area visible from the apartment as well as the street. (8) As you are aware, the City Commission has required sidewalks along all street rights-of-way. Sidewalks will need to be installed along Tracy Avenue and Carol Place. F Clair W Daines Inc. The landscaping must meet the minimum require- ments and the information included on the site plans. (10) The site plans must contain the legal description of the property and name and address of the applicant. (11) The plans only show two unit types. Please label the two units and indicate that's all there will be. If another type is to be included, its floor plans also need to be provided. I hope this gives you enough information to complete your submittal . The applica- tion cannot be processed unless it is complete and contains all information required in Section 18.54.250 of the zoning ordinance. It is more commonly located at the corner of Kagy Blvd . and Carol Place. Please refer to the location map. HOFFMAN U Q 1 ♦ J N � } c R - VALLEY VIEW rrA The property is zoned R-3 , medium density residential . The application 'is to construct a 6 unit structure on two (2) lots approximately 23 , 075 sq. ft. in size. The property is fronted on 3 sides by streets, which effectively places approximately 50% of their total area in the required 25 ft. front yard . setbacks. According to the P. U.D. density standards, the applicant should be able to place approximately 8 units on the 2 lots. He is requesting 6. A stream also runs through the property in a south east to north west direction. It effectively cuts off approximately 1/3 of the property. Mr . Daines did request to relocate the stream and was denied. He then requested a variance to waive the front yard set . 1 . r backs and the stream setbacks to allow him to construct an 8 car off-street parking facility. That request was approved by the Zoning Board of Adjustments. The Staff has reviewed the proposed project with the Building Official and as a result, it was noted that the location of the off-street parking facility as shown on the site plans is not in the same location as granted by the Board of Adjustments. Therefore, the facility will have to be relocated to align with that which was approved by the Board of Adjustments. Due to this requirement, the garage will also have to be relocated . It was originally suggested that it be placed in the area occupied by the parking stalls numbered 7 and 8 on the site plan . The Staff suggested that it be relocated for security reasons. However , it cannot be located in the required front yard area. For that reason, it must be relocated. The drainage from the parking area is to be conducted to the northwest boundary and then filtered through a gravel and vegetation area and will eventually empty into the stream. This will have to be reviewed and approved by the Fish and Game Department and the Engineering Officer prior to final site plan approval . The developer has discussed the dumpster location with the Street Superintendent. Its location is easily accessable to the pick-up vehicles . Sidewalks are to be provided along Black Avenue and Carol Place rights-of-way. The developer has requested it to be noted that he is providing them under protest. His argument is that there are no other sidewalks in the general vicinity. He strongly feels that if sidewalks are to be installed , they must go somewhere and everyone should have to install them. He feels the City should make it a city-wide policy. The mail drop facilities have not been shown as to their location . This needs to be reviewed and approved by the Postal Service. The applicant must keep in mind that there is a needed 15 ft. sight distance triangle for all drive areas that must be left open. For this reason, the mail drop facilities should not be located near the drive entrances. The applicant must receive a 310 permit from the Soil Conservation District to cross the stream. The permit must be issued prior to final site plan approval . STAFF FINDINGS The Planning Staff has reviewed the submittal for minor P.U.D. approval and as a result has found it to be in general compliance with the Zoning Regulations. That the developer enter into an improvements agreement with the City of Bozeman. If the structure is to be occupied prior to the installation of all scheduled improvements, the developer must submit a method of security equal to one and one half (1-1/2 ) times the estimated cost of the remaining improvements. Said security must be made payable to the City of Bozeman and must be negotiable by them for a minimum of 90 days after the expiration date of the letter of credit. 7. That the developer submit 3 copies of the final site plan to the Planning Director for his review and approval . The Staff has reviewed the proposal and as a result; have determined that the project must be approved through the public hearing process. Section 18.54.080 of the Bozeman Area Zonina Ordinance allows 15 residential units per acre in an R-3 Zoning District. This requires a lot area of 2,904 square feet per unit. Two thousand eight hundred and eighty-four square feet per unit is being provided. Since a hearing is required, an additional $100 in review fees is required. During the Staffs review of the project, the following observations were made: 1. Since the stream is to be relocated, a 310 Permit must be applied for and received from the Soil Conservation Service. The conditions of their approval are usually made part of any conditional approval granted by the City Commission. 2. The parking to be provided within the structure is going to be rather tight. However, you are satisfying the requirements of the Zoning Code. Detailed information concerning this area should be included with the P.U.D. submittal . 3, Lot dimensions and setbacks need to be accurately shown on the site plan. 4. Pedestrian walkways will be required between the outside parking area and the apartment complex. They may also be required along the street frontage of Carol Place and South Black Avenue. 5. Further detail will need to be provided concerning the exterior parking area in relation to the treatment of storm runoff, drainage, snow removal , buffering, exterior light, paving and landscaping. The Board felt to grant this variance would not be contrary to the public interest with regard to safety or convenience. Appeal of Clair Da.ines, 2015 South Black Avenue The appeal of*Clair W. Daines, Inc. was brought before the Board. The appeal was from the refusal of the Building Official to issue a permit to build eight condominium units on lots 1 and 2, block 8, Thompson's 4th Addition. The Secretary read the letter from the Buildi.ng Official to Mr. Daines and two letters of protest from owners of three lots within one hundred. and fifty feet of the proposed project. Mr. Daines was present to answer questions from the Board concerning this variance. Mr. Daines told the Board the two lots in question lies directly across Kagy Blvd. from the Westridge Technical Center. He said he and others had developed a large area of the immediate adjacent lots t about ten years ago. He said about a year ago he had applied for. a 310 permit and then had gotten busy with other projects and not used the permit. During this time the City passed the Water Course Ordinance rather quietly. The lots are 80' wide and 80' to 90' deep. He said there are S.I.D. 's against the lots which bring the value of the lots to around $50,000. He was told by the Planning Staff that it would be a routine matter for the Board of Adjustment to act on the request and then he could request the 310 permit and go thru a Planned Unit Development process with the Planning Staff. He stated the lots could not be built on withouta variance of the Board of Adjustment because with the stream running thru as it is there is no way to obtain the proper setbacks. A culvert will be constructed across the stream. He stated he assumed the concern is for protecting the stream and native habi.tat which there is little of in this stream. Mr. Daines said he. has lived in the area about twenty years andlfeels there is very little flood potential from this stream. There was no one present to speak against the variance. Les Nielsen asked Mr. Daines where the stream originates. Clair Daines said the stream is apparently an irrigation ditch which has been re-routed over the years and the stream comes from a pond which forms on the Valley View Country Club property. A discussion of the stream followed and Mr. Daines showed the Board members the location on the map. Tom Messick asked if the R-3 zoning would allow eight condominium units. Gene Yde pointed out the Board was ruling strictly on the water ' course setback at this time and that the other violations would be reviewed by other departments. Duncan MacNab asked how close the stream is to the buildings. Mr. Daines told him he would probably build the building on one lot and use the other lot strictly for parking. Gene Yde told Mr. MacNab he didn't have accurate drawings but it looked like about a 15' setback. Mr. Daines again said the lots would be unuseable without a variance. There being no further discussion .the Chairman called for a motion on the variance. Les Neilsen moved the appeal be granted, and it was seconded by Leo Hoffart. The motion carried by the following .vote: Those voting Yes being Duncan MacNab, Leo Hoffart, Les Nielsen and Harold Goble, those voting No, being Tom Messick. APPEAL GRANTED. The Board based their approval on the assumption that a 310 permit can be obtained from the Soil Conservation District and that a Planned Unit Development is approved by the City-.County Planning Staff.
