Said method of security shall be valid for a period of not less than twelve ( 12 ) months . In any event, all required improvements on the site as delineated on Exhibit "A" , which is attached and made a part of this Agreement , shall be completed within nine ( 9 ) months of occupancy in order to avoid default on the method of security . 4 . Inspection Representatives of the City shall have the right to enter upon the property at any reasonable time in order to inspect it and to determine if the Developer is in compliance with this Agreement, and the Developer shall permit the City and its representatives to enter upon and inspect the property at any reasonable time . 5 . Default Time is of the essence of this Agreement. If the Developer shall default in or fail to fully perform any of its obligations in conformance with the time schedule under this Agreement, and such default or failure shall continue for a period of thirty ( 30) days after written notice specifying the default is deposited in the United States mail addressed to the Developer at P. Warranty The Developer shall warrant against defects in these improvements for a period of one year from the date of their written acceptance by the Governing Body . Any required landscaping must be maintained in a healthy , growing condition at all times . Any plant that dies must be replaced with another living plant that complies with the approved landscape plan . 7 . Governing Law This Agreement shall be construed according to the laws of the State of Montana. 8. Spring Meadows Subdivision PUD was approved by the City Commission in 1987 . The subdivision incorporates 18. 6 acres of land, and was divided into 27 lots. Spring Meadows Drive and Billion Place are private streets within the subdivision which serve single-family lots. Graf Street and South Graf Avenue, which serve the multi-family lots, are public streets. All private and public roads are installed, as well as city water and sewer mains, and two storm drainage facilities. i 0° i s A full Community Impact Statement and Environmental Assessment were provided and reviewed during the subdivision review process, and 2 . 57 acres of park land was dedicated with the subdivision. This park land provides an extension of the Sourdough Trail from East Graff Park. The subdivision was approved for 24 single-family homes and 18 multi-family units, which are to be located on two lots, as well as a 75 unit retirement center. Therefore, it has always been the intent to utilize the subject lot for multi-family units. I n AGE OR i Proposal The applicants are proposing to construct three four-plex residential townhouse units on the property in question. The lot is 1 .45 acres in size and is zoned R-2 , Residential Single Family, Medium Density District. Each structure would have an approximately 6 , 320 sq . ft. footprint, individual garages, a combination of masonry and cedar or hardboard horizontal siding, and asphalt shingles. i The lot adjoins public park on the north and east, and undeveloped land on the south. Access to the property is from South Graf Avenue, via South Third Street and Graf Street. Background The property in question is a portion of Spring Meadows PUD which was approved through the Conditional Use Permit procedures in June 1987 . At that time, Lot 1 , Block 2 and Lot 1 , Block 3 (subject site) were designated to accommodate a maximum of 18 multi-family dwelling units. The units may be divided between the two lots in any arrangement as long as all zoning requirements are met. As 12 units are being proposed for Lot 1 , Block 3, the remaining six dwelling units could be constructed on Lot 1 , Block 2 in the future. The Design Guidelines for the PUD requires all development, other than single-family, to be reviewed by the Planning Staff for compliance with the Development Guidelines and the 1986 Zoning Ordinance within 15 days. After this review, Staff is required to submit a report to the Planning Board (who serves as the Zoning Commission) with their recommendation. A majority of the Board may request a public hearing on the proposed development within three days of receipt of the report. If a public hearing is not requested by a majority of the Board, the proposal is approved, conditionally approved, or denied per the recommendation in the Staff Report. Staff Findings The proposal , as submitted, generally meets all requirements of the 1986 Zone Code and Spring Meadows PUD Development Guidelines. The only item which has not been met is that 13 Seedless Cottonwood trees must be shown on the site plan , per the 6/13/88 Landscape Plan for the PUD. The site plan , including drainage, signs, landscape and elevations, must also be approved by the Spring Meadows Architecture Committee. Staff has forwarded the proposal to the Committee for their review. The submittal was forwarded to the City' s Development Review Committee for review. In order to ensure the development of the City in an orderly , safe and efficient manner, the following conditions were requested: The proposed storm drainage system/layout must be approved by the City Engineering Office prior to Final Site Plan approval to ensure adequate storm water retention/detention. - Because the structures are being developed as Townhouses, individual water and sewer service must be provided to each unit. This will require an extension of the water and sewer mains into the lot and the installation of one or more manholes, which must be approved by the City and the State Department of Health and Environmental Sciences prior to construction of said mains. A utility easement must also be granted to the City for future servicing of the mains. - A curb cut permit must be secured from the City Engineering Department prior to construction of the access. The Final Site Plan must show the limits of the existing curb, gutter and sidewalk and the future extension of the same to the southern edge of the subject property. - To ensure adequate fire protection to all buildings on the site, an on-site fire hydrant must be installed in a location approved by the City Water and Fire Departments. - The applicant shall be made aware that the relocation of the temporary cul-de-sac on South Graf Avenue may be necessary as a result of this development. Conclusion Based on the comments received from various City Departments as well as on the Planning Staff's review of the project against the 1986 Zone Code and Spring Meadows PUD Development Guidelines, it is recommended that this Minor PUD be approved to allow the construction of three four-unit townhouse structures on Lot 1 , Block 3, Spring Meadows Subdivision PUD, with the following conditions: 1 . That the site plan, including drainage, signs, landscape and elevations, be approved by the Spring Meadows Architecture Committee prior to Final Site Plan approval ; 2 . That plans and specifications for water and sewer main extensions, including inspection, certification and as-built drawings, as well as any necessary manholes, i .e. sewer connection in Graf Street, be approved by the City Engineering Office and State Department of Health and Environmental Sciences prior to construction of the mains; I 3 . That an on-site fire hydrant be installed on the property in a location approved by the City Water and Fire Departments, and the location of the hydrant be shown on the Final Site Plan; 4 . That a written 30-foot wide utility easement be provided for the extension of the water and sewer mains as well as the on-site f i re hydrant, and that the document be reviewed and approved by the City Engineering Office. The final document shall be recorded at the County Clerk and Recorder's Office prior to Final Site Plan approval ; 5 . That the Final Site Plan landscape plan comply with the master landscape plan for the PUD and show that eight (8) 4 1/2-foot high minimum Seedless Cottonwoods will be planted on the north lot boundary, and five (5 ) 4 1/2-foot high minimum Seedless Cottonwoods will be planed on the east lot boundary; 6 . That a curb cut permit must be secured from the City Engineering Department prior to construction of the access. The Final Site Plan must show the limits of the existing curb, gutter and sidewalk and the future extension of the same to the southern edge of the subject property; 7 . The proposed storm drainage system/layout must be approved by the City Engineering Office prior to Final Site Plan approval ; 8. Seven copies of the Final Site Plan containing all of the conditions, corrections and modifications listed above shall be submitted for review and approved by the Planning Director within six months of the date of approval ; 9 . The applicant shall enter into an Improvements Agreement with the City to guarantee the installation of required on-site improvements at the time of Final Site Plan submittal . Detailed cost estimates, construction plans and methods of security shall be made a part of that Agreement; 10. A Building Permit must be obtained within one year of Final Site Plan approval . Building Permits will not be issued until the Final Site Plan is approved. No site work, including excavation , may occur until a Building Permit is issued; 11 . If occupancy of the structure is to occur prior to the installation of all improvement, the Improvements Agreement must be secured by a method of security equal to one and one-half times the amount of the estimated cost of the scheduled improvements not yet installed. Said method of security shall be valid for a period of not less than 12 months; however, all on-site improvements shall be completed by the applicant within nine months of occupancy to avoid default on the method of security. This condition is to satisfy City Zoning requirements. The Development Guidelines require that all landscape improvements be completed within 15 months of the start of construction. This report is being mailed to the Planning Board on Friday, September 27 , 1991 . A request for public hearing on the project must be made to the Planning Office by Wednesday, October 2, 1991 .
