prepared by your firm and are dated May 1989 . This approval
is contingent upon receipt of signed easement dedicated to
the City of Bozeman for the new water main. It is also
subject to the following stipulations :
1 . All arrangements for water for flushing, testing and
construction will be made through the city water
department .
2 . Tapping sleeves shall be a Mueller Model H615 .
3 . Valve boxes shall be as manufactured by Tyler.
4 . Fire hydrants shall be Mueller Centurion only.
5 . All valves on the project shall be provided with
thrust blocking.

to this office . I would also ask that you keep Andy Kerr
of this office informed of the construction schedule for this

IMPROVEMENTS AGREEMENT
FOR
Hi-LAND PROPERTIES, INC.
This AGREEMENT is made and entered into this 0-5--�i'day of
�-� 1989, by and between HI-Land Properties, Inc. ,
hereinafter called the "Developer" , and the City of Bozeman, a
municipal corporation of the State of Montana, hereinafter called
the "City" .
WHEREAS, it is the intent and purpose of the Developer to meet
the conditions of approval for Conditional Use Permit #Z-8904 for
a Minor Planned Unit Development (PUD) allowing the construction
of an eight unit motel at 1207 East Main Street on property already
containing a mobile home park, an apartment building and a single-
family residence;
WHEREAS, it is the intent of the Developer to obtain Final
Site Plan Approval and a building permit for the project;
WHEREAS, it is the intent and purpose of both the Developer
and the City to hereby enter into an agreement which will guarantee

the full and satisfactory completion of the required improvements
on the property hereinafter described; and it is further the
intent of this agreement, and of the parties hereto, to satisfy the
improvements guarantee requirements for the Final Site Plan
approval of said Conditional Use Permit;
NOW, THEREFORE, in consideration of the mutual covenants and
conditions contained herein, it is hereby agreed ,as follows:
1 . Property Description
This. Agreement pertains to, and includes, that property which
is designated and identified as Amended Plat C-23-B, Tract A of
Block 27 in the Northern Pacific Addition to the City of Bozeman,
located in the Northwest Quarter of Section 8, T. 2S, R.6E, M. P.M. ,
Gallatin County, Montana. It is more commonly described as 1207
East Main Street in Bozeman, Montana.

2 . Improvements
This Agreement specifically includes the installation of
695 linear feet of water line improvements, 3964 square feet of
asphalt paving, 118 linear feet of curbing, 344 square feet of
sidewalk (4' width) , eight (8) concrete wheel 'stops, striping for
eight (8) off-street parking spaces, one enclosure for garbage
dumpster per Section 18. 62 . 120 D, and 5 , 124 square feet of
landscaping as illustrated on the approved Final Site Plan and made
part of this Agreement, as Exhibit "A" . The estimated cost of said
improvements is attached and made part of this Agreement, as
Exhibit "B" .
3. Financial Guarantee Time for Completion of Improvements
If occupancy of the new eight unit motel is to occur prior to
completion of the improvements, it must be secured by financial
guarantee, as may deemed acceptable by the City, payable to the
City of Bozeman, in an amount equal to one and one half times the
estimated cost of the installation of any required improvements not
completed at the time of occupancy.
In any event, all required improvements on the site as
delineated on Exhibit "A" , which are attached and made a part of
this Agreement, shall be completed on or before January 17 , 1991 .
4. Default
Time is of the essence of this Agreement. If the Developer
shall default in or fail to fully perform any of its obligations
in conformance with the time schedule under this Agreement, and
such default or failure shall continue for a period of five (5)
days after written notice specifying the default is deposited in
the United States Mail addressed to the Developer at 1207 East Main
Street, Bozeman , Montana 59715 , or such other address as the
Developer shall provide to the City from time to time, without
being completely remedied, satisfied , and discharged , the City may
elect to enforce any of the following specified remedies:

A. The City may, at its option, declare that the granted
Conditional Use Permit (CUP) has been violated and initiate a
revocation of the CUP based on Section 18. 52 . 110 of the Bozeman
Zoning Code.
B. The City may enforce any other remedy provided by law.
5 . Inspection
Representatives of the City shall have the right to enter upon
the property at any reasonable time to inspect and to determine if
the Developer is in compliance ' with this Agreement and ,the
Developer shall permit the City and its representatives 'to enter .
upon and inspect the property at any reasonable time.
6 . Warranty
The Developer shall warrant against defects in these
improvements for a period of one year from the date of their
written acceptance by the Governing Body. In addition, all
landscaped areas required by this agreement shall be permanently
maintained by the Developer pursuant to Section 18. 62 . 130 E. of
the Bozeman Area Zoning Code.
7 . Governing Law
This Agreement shall be construed according to the laws of
the State of Montana.
8. Modifications or Alterations
No modifications or amendment of this Agreement shall be valid
unless evidenced by a writing signed by the parties hereto.
9 . Invalid Provision
The invalidity or unenforceability of any provision of this
Agreement shall not affect the other provisions hereof and this
Agreement shall be construed in all respects as if such invalid or
unenforceable provision were omitted.
10. No Assignment
It is expressly agreed that the Developer shall not assign

this Agreement in whole or in part without prior written consent
of the City.
11 . Successors
Except as provided in paragraph 10, this Agreement shall be
binding upon, enure to the benefit of, and be enforceable by the
parties hereto and their respective heirs, successors, and assigns.

Dear Bernie:
This letter is to inform you that the Planning Director has
conditionally approved your Conditional Use Permit application
for a Minor Planned Unit Development at 1207 East Main Street
with the following attached conditions:
1. The Final Site Plan shall contain all of the submittal
information, including engineering and fire data, as required by
Section 18. 54. 250 of the Zoning Cade, and water, sewer and
drainage plans must be approved by the Director of Public Service
prior to Final Site Plan approval ;
2. All required yard set-backs shall be provided on the Final
Site Plan as stipulated in Section 18. 54. 114 of the Zoning Cade;
3. The Final Site Plan shall show at least 30 percent open
space for this proposal ;
4. Three copies of the Final Site Plan containing all the condi-
tions, corrections, and modifications approved by the Planning
Director, shall be submitted for review and approval by the
Planning Director within six months of the date of Conditional
approval. A Final Site Plan must be approved prior to the
issuance of a building permit or business license for the
project, or commencement of the use. One siqned copy shall be
retained by the Planning Director, one signed copy shall be
retained by the Building Department, and one signed copy shall be
retained by the applicant;
5. If improvements are not installed prior to Final Site Plan
approval, the applicant shall enter into an improvements agree-
ment with the City. Detailed cost estimates, construction
plans, and methods of security shall be made a part of that

to occur prior to the installation of improvements, the Agreement
must be secured by a method of security equal to one and one-half

7. All on-site improvements - shall be completed within 18 months
of Final Site Plan approval of the Conditional Use Permit. The
Conditional Use Permit shall be valid for a period of 18 months
following approval of the Final Site Plan. Prior to the perma-
nent renewal of the Permit at the end of the 18 month period,
the applicant must satisfy all of the conditions in the granting
of the Permit. An on-site inspection will be made - and a report
made to the Planning Director for his action. If all required
conditions have been satisfied, the Permit will be permanently
renewed.
Condition #4 of your preliminary approval states that you must
receive Final Site Plan approval from the Planning Director
within six months of receiving conditional approval of your
application. This means you must submit a Final Site Plan to
the Planning Office no later than September 9, 1989 in order to
meet the above condition. Once you have received Final Site
Plan approval from the Planning Director, you have eighteen (18)
months to fully satisfy all of the seven conditions imposed on
your Conditional Use Permit. If you have satisfied all of the
imposed conditions within the allotted. 18 months, a permanent
Conditional Use Permit will be issued. However, if you fail to
comply with any of the seven conditions . within 18 months of
conditional approval , then your Conditional Use Permit becomes
invalid.

Proposal
The applicant is proposing to construct an eight unit motel
building on a 2. 9 acre parcel in the "H-2" zoning district at
1207 East Main Street. The proposed site is located on a parcel
which currently contains a 12 unit motel building, 30 mobile
homes, and a single family residence/office. The applicant plans
to remove five of 'the existing mobile homes, numbered 30-35 on
the site plan, and replace them with the new motel building.
Because ' the parcel in question will contain more than one
principal structure, the new motel must be approved as a Planned
Unit Development . (PUD) which requires a Conditional Use Permit
as outlined in Section 18. 54 of the Zoning Cade. The Planning
Director has determined that this Conditional Use application
does qualify for review as a Minor PUD pursuant to. Section-
18. 54.30 of the Zoning Cade. Therefore, unless a majority of
the Zoning Commission requests it, a public hearing will not be
required for this proposal .
Staff Findings
Planned Unit Developments are listed as Conditional Uses in the
"B-2" zoning district and must undergo the Conditional Use
Permit process. Section 18. 52. 010 (B) of the Zoning Code
establishes six criteria which must be considered in the review
of Conditional Use Permit Applications. The Planning Staff has
reviewed the applicant' s submittal for compliance with those
criteria and .offers the following comments.
1 . The proposed use meets . all submittal requirements as contain-
ed in Section 18. 52. 120.
The following items need to be included on the Final
Site Plan for this proposal : 1 ) correct orientation and
placement of the proposed motel structure' 2) all
applicable yard set-back lines; 3) correct dimensions
for parking spaces and drive aisles; 4) any proposed
signage; 5) address of the subject property.
2. The proposed use will not, particularly because of conditions
imposed, be detrimental to the public health, safety, or general
i welfare of persons residing or working in the vicinity, or
I injurious to property or improvements in the vicinity.
The Director of Public Service has reviewed this proposal and
recommends that the following be addressed can the Final Site
Plan for review and approval by that office;
1 ) Size, location, slope and tie-in location of proposed
and existing sanitary sewer service lines;
2) Location of all fire hydrants on the property;

37 Water service main is not adequate-show anticipated
upgrade, location of new service line. Include fire flew
in sizing;
4) Location of snow removal area;
5) Identify maximum number of occupants per room;
6) Drainage and detention details;
7) the access entry should be identified and its width
restricted to 261 ;
3. The proposed use will comply with regulations and standards
specified in the Bozeman City Zoning Code, codified in this title
for such use.
Section 1B. 54. 110 of the Zoning Cade, regarding
set-backs for PUD' s, requires eleven feet of yard space
between any two-story building and an adjacent struc-
ture. This section also requires that any two story
be set back: eleven feet from any exterior property
boundary. It appears that the applicant' s proposal
shows a ten foot, instead of an eleven foot, set-back:
from the west property line. The Final Site Plan must
show the required eleven foot set-back: for this area.
Staff has determined that, depending on how the new
building is oriented on the proposed site, the proposal
may come up short in providing the required 30 percent
open space as stipulated in Section 1&. 54. 140 of the
Zoning Code. Consequently, the Final Site Plan must
show. clearly the total amount of open space proposed
for the site in question in order for the Staff to
make an accurate determination for this requirement.
4. The granting of the Conditional Use Permit will be in general
compliance with the Bozeman Area Master Plan, and the require-
ments as set forth in this Chapter.
The subject property is located in an area designated
for General Highway Commercial development on the Land
Use Map of the Bozeman Area Master Plan. - The parcel is
zoned "B-2" Community Highway Business District. The
proposed PUD (eight unit motel ) appears to be in
compliance with the Bozeman Area Master Plan.
5. The proposed use - conforms to the standards of this chapter
including, but not limited to, density, lot coverage, yards and
height limitations as set forth in this Chapter, unless otherwise
provided for in this Cede.

Except for the possibility that the yard set-back and
open space areas may need to be adjusted as mentioned
above, the proposal complies with the standards as set
forth in this Chapter.
6. The proposed use has been duly noticed, and a public hearing
held in accordance with Section 18. 52. 02, and the public has
been given sufficient opportunity to be heard upon the matter.
Unless a majority of the Zoning Commission requests
that the proposed PUD be reviewed at a public hearing,
that requirement does not apply to this proposal as
determined by the Planning Director in accordance with
i Section 18. 54.3 of the Zoning Cede.
Conclusion
The Planning Staff has reviewed the request for a Conditional
Use Permit for a Minor Planned Unit Development to . allow the
construction of an eight unit motel building on the same lot as
an existing 12 unit motel , mobile home part: and single family
residence /office and recommends approval of the application
with the following attached conditions:
i 1 . The Final Site Plan shall contain all of the submittal
information, including engineering and fire data, as required by

Location/Description
The Subject property is described as Tract A, of Amended Plat
C-23-B in the Northern Pacific Addition to the City of Bozeman
in the NW 1/4 of Section 8, T2S, R6E, M. P.M. , Gallatin County,
Montana. It is more commonly known as 1207 East Main Street.

Proposal
The applicant is proposing to construct an eight unit motel
building on a 2. 9 acre parcel in the "B-2" zoning district at
1207 East Main Street. The proposed site is located on a parcel
which Currently contains a 12 unit motel building, 30 mobile
homes, and a single family residence/office. The applicant plans
to remove five of the existing mobile homes, numbered 30-35 on
the site plan, and replace them with the new motel building.
Because the parcel in question will contain more than one
principal structure, the new motel Must be approved as a Planned
Unit Development (PUD) which requires a Conditional Use Permit
as outlined in Section 18. 54 of the Zoning Cade. The Planning
Director has determined that this Conditional Use application
does qualify for review as a Minor PUD pursuant to Section
18. 54.30 of the Zoning Code. Therefore, unless a majority of
the Zoning Commission requests it, a public hearing will not be
required for this proposal .
Staff_Findings
Planned Unit Developments are listed as Conditional Uses in the
"8-2" zoning district and must undergo the Conditional Use
Permit process. Section 18.52. 010 (EO) of the Zoning Code
establishes six criteria which must be considered in the review
of Conditional Use Permit Applications. The Planning Staff has
reviewed the applicant' s submittal for compliance with these
criteria and offers the fallowing comments.
1 . The proposed use meets all submittal requirements as contain-
ed in Section 18. 52. 120.
The following items need to be included on the Final
Site Plan for this proposal : 1 ) correct orientation and
placement of the proposed motel structure; 2) all
applicable yard set-back: lines; 3) correct dimensions
for parking spaces and drive aisles; 4) any proposed
signage; 5) address ��f the subject property.
2. The proposed use will not, particularly because of conditions
imposed, be detrimental to the public health, safety, or general
welfare of persons residing or working in the vicinity, or
injurious to� property or improvements in the vicinity.
The Director of Public Service has reviewed this proposal and
recommends that the following lowing be addressed on the Final Site
Plan for review and approval by that office;
1 ) Size, location, slope and tie-in location cif proposed
and existing sanitary sewer service lines;
2) Location of all fire hydrants on the property;

4) Location of snow removal area;
5) Identify maximum number of occupants per room;
6) Drainage and detention details;
77 The access entry should be identified and its width
restricted to 261 ;
3. The proposed use will comply with regulations and standards
specified in the Bozeman City Zoning Code, codified in this title
for such use.
Section 18.54. 110 of the Zoning Code, regarding
set-backs for PUD' s, requires eleven feet of yard space
between any two-story building and an adjacent struc-
ture. This section also requires that any two story
be set back eleven feet from any exterior property
boundary. It appears that the applicant' s proposal
shows a ten foot, instead of an eleven foot, set-back
from the west property line. The Final Site Plan must
show the required eleven foot set-back for this area.
Staff has determined that, depending on how the new
building is oriented on the proposed site, the proposal
may come up short in providing the required 30 percent
open space as stipulated in Section 18. 54. 140 of the
Zoning Code. Consequently, the Final Site Plan must
show clearly the total amount of open space proposed
for the site in question in order for the Staff to
make an accurate determination for this requirement.
4. The granting of the Conditional Use Permit will be in general
compliance with the Bozeman Area Master - Plan, and the require-
ments as set forth in this Chapter.
The Subject property is located in an area designated
for General Highway Commercial development on the Land
Use Map of the Bozeman Area Master Plan. 'The parcel is
zoned "B-:2" Community Highway Business District. The
proposed PUD (eight unit motel ) appears to be in
compliance with the Bozeman Area Master Plan.
5. The proposed use conforms to the standards of this chapter
including, but not limited to, density, lot coverage, yards and
height limitations as set forth in this Chapter, unless otherwise
provided for in this Code.

Except for the possibility that the yard set-back and
open space areas may need to be adjusted as mentioned
above, the , proposal complies with the standards as set
forth in this Chapter.
6. The proposed use has been duly noticed, and a public hearing
held in accordance with Section 18. 52. 02, and the Public has
been given sufficient opportunity to be heard upon the matter.
Unless a majority of the Zoning Commission requests
that the proposed PUD be reviewed at a public hearing,
that requirement does not apply to this proposal as
determined by the Planning Director in accordance with
Section 18. 54.3 of the Zoning Code.
Conclusion
The Planning Staff has reviewed the request for a Conditional
Use Permit for a Minor Planned Unit Development to allow the
-construction of an eight unit motel building on the same lot as
an existing 12 unit motel , mobile home park- and single family
residence /office and recommends approval of the application
with the following attached conditions:
1 . The Final Site Plan shall contain all of the submittal
information, including engineering and fire data, as required by
Section 18. 54. 250 of the Zoning Code, and water, sewer and
drainage plans must be approved by the Director of Public Service
prior to Final , Site Plan approval;
2. All required yard set-baci.-.s shall be provided on the Final
Site Plan as stipulated in Section 18. 54. 110 of the Zoning Code;
3. The Final Site Plan shall show at least, 30 percent open
space for this proposal;
4. Three copies of the Final Site Plan containg all the condi-
tions, corrections, and modifications approved by the Planning
Director, shall be submitted for review and approval by the
Planning Director within six months of the date of Conditional
approval. A Final Site Plan must be approved prior to the
issuance of a building permit or business license for the
project, or commencement of the use. One signed copy shall be
retained by the Planning Director, one signed copy shall be
retained by the Building Department, and one signed copy shall be
retained by the applicant;
S. If improvements are not installed prior to Final Site Plan
approval , the applicant shall enter into an improvements agree-
ment with the City. Detailed cost estimates, construction
plans, and methods of security shall be made a part of that

Agreement;
S. If occupancy of the structure or commencement of the use is
to occur prior to the installation of improvements, the Agreement
must be secured by a method of security equal to one and one-half
times the cost of the scheduled improvements;
7. All on-site improvements shall be completed within 18 months
of Final Site Plan approval of the Conditional Use Permit. The
Conditional Use Permit shall be valid for a period of 18 months
following approval of the Final Site Plan. Prior to the perma-
nent renewal of the Permit at the end of the 18 month period,
the applicant must satisfy all of the conditions in the granting'
of the Permit. An on-site inspection will be made and a report
made to the City Commission for their action. If all required
conditions have been satisfied, the Permit will be permanently
renewed.

ATTACHMENT
The required data to be shown on the Site Plan shall include, but is
not limited to, the following :
A. SITE PLAN:
1. A title block showing name and address of applicant (s) , property
owners and name and address of proposed project and site and date
of preparation;
2. Scale and north arrow;
3. Property lines with dimensions;
4. Setback lines (specify front, side and rear yard areas) with
dimensions;
5. Existing and proposed easements, indicating name, width, and
purpose (utilities, streets, etc. ) ; and location of existing
services (water , sewer , gas, electric) ;
6. Topographic features (where applicable) , including but not
limited to: embankments, water courses (streams, creeks, etc. ) ,
drainage channels, areas of seasonal water ponding , floodplains,

common names , and estimated sizes at time of installation
and at maturity;
C. Location of individual plants and trees showing approximate
distances from roadways and buildings ;
d. Description and location of additonal ground cover ;
e. Description and location of any proposed ornamental land-
scaping elements (colored and crushed rock , gravel , large
boulders, wagon wheels, etc. ) ;
f. Description , location and dimension of landscaping protec-
tive devices.
2. All landscape plans shall be prepared and certified by a licensed
landscape architect or nurseryman for uses requiring more than
fifteen parking spaces.
