I am writing to recommend that you pull item H.19 Ordinance 2149, Final Adoption of the
Short Term Rentals Text Amendment, Application 23281 from the consent agenda thisevening for the following reasons:
The surgical precision that was required in drafting the new language deteriorated upon theaddition of a grandfathering clause for existing type three rentals.
If type three STRs are problematic enough to ban future permits, then why would we codify,without sunset, the ones already operating?
If we want to protect the interest of type three owners residing within our community- andprotect housing stock from non-local wealth-extracting markets, then something as simple as
making a local residency requirement of any host to live within the community could helpaccomplish this.
Given the high cost and demand for guest lodging here, I believe we could draft policy thatensures more equitable access to participation in this market for those natural
persons presently living and contributing to this community. Because of procedure, thegrandfathering change was added after public comment was received by both the commission
and various advisory boards, and substantially changed the outcome of the ordinance asproposed and publicly noticed leading up to those meetings.
Furthermore, parts of the added text of section 7 on Legacy Type 3 properties is troublinglyunclear. It uses the term "host" numerous times, but the definition of "host" (38.360.260.C.2)
or "change in status of host" (38.360.260.H.8) are nonsensical in application to a type threepermit.
At the recent economic vitality board meeting, members asked clarifying questions thatcommissioner liaison Coburn said would need to be addressed. However, he will not be in
attendance this evening. Final adoption of such a contentious ordinance (one with lastminute changes) by only 3 out of our 5 leaders present- especially as a consent item lacking
discussion is a disservice to our community. Thank you for your service and consideration of this comment.
