Do not click links or open attachments unless you recognize the sender and know the content is safe. Bozeman City Commission, I'm writing again regarding the urban camping issue in our city. While the new ordinance that you passed will eventually take effect, you continue to ignore blatant violations of Chapter 16 Montana's Code of Ordinances. None of which violate the Martin v. Boise and Johnson v. City of Grants Pass decisions. Take a visit to Hemlock street or look at the attached photo and tell me how this doesn'tviolate Chapter 16 below. Trash, furniture, stolen shopping carts, junk are constantly litteredall over the sidewalk and road."Every owner, occupant, lessee or holder of any possessory interest of real propertywithin the city is required to maintain such property. The owner of the property shallremain liable for violations hereof....The following may be declared to be public nuisances:1. Any condition which constitutes an attractive nuisance whether within a structure oron the premises.2. Any building or place which has been operated or maintained in a manner that hasresulted in repeated disruptive activities including, but not limited to, disturbances ofthe peace, public drunkenness, drinking in public, harassment of passersby, sale ofstolen goods, public urination, theft, assaults, batteries, acts of vandalism, excessivelittering, illegal parking, loud noises (particularly in late night or early morning hours),traffic violations, or police detentions and arrests.3. The keeping, storage, depositing or accumulation on the premises for anunreasonable period of time of any personal property or wastes, including, but notlimited to, abandoned, wrecked, dismantled or inoperative vehicles, abandoned,wrecked, or dismantled boats or vessels, automotive parts and equipment, appliances,furniture, containers, packing materials, scrap metal, wood, building materials, junk,rubbish, debris, dirt, sand, gravel, concrete or other similar materials which is withinthe view of persons on adjacent or nearby real property or the public right-of-way andwhich is detrimental to the public health, safety and general welfare. However, buildingmaterials being used or to be used for a project of repair or renovation for which abuilding permit has been obtained may be stored for such period of time as is necessaryto expeditiously complete the project." We have previously been in consistent communication with Bozeman PD due toseveral incidents that occurred on and in front of our property. Bozeman PD has been helpful in lieu of this and we appreciate all that they are trying to do. However, they are short staffed and do not have the adequate resources to handle this situation without help from the city. While I feel that the new ordinance is watered down, I'm hopeful that you will follow through and enforce it exactly as described. The RVs on our street are all within 100- feet of our businesses.
