HomeMy WebLinkAboutResolution 3000 Create SID 662 - paving N. 19th, West Oak to Baxter ~ - COMMISSION RESOLUTION NO. 3000 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 662 FOR STREET IMPROVEMENTS FOR THE ENGINEERING, CONSTRUCTION, INSPECTION AND ENGINEERING CERTIFICA TION OF ASPHALT CEMENT PA VING, GRAVEL BASE COURSES AND SUBGRADE PREPARATION, STORM DRAINAGE, AND ALL NECESSARY APPURTENANCES TO CONSTRUCT A 2,691-FOOT PORTION OF NORTH 19TH A VENUE BETWEEN BAXTER ROAD AND WEST OAK STREET, IN THE CITY OF BOZEMAN, MONTANA. WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana, held on the 13th day of June 1994, the City Commission duly passed Commission Resolution No. 2982, declaring it to be the intention of said City Commission to create a Special Improvement District to be known and designated as Special Improvement District No. 662 for street improvements for the engineering design, construction, inspection and engineering certification of asphalt cement paving, gravel base courses and subgrade preparation, storm drainage, and all necessary appurtenances to construct a 2,691-foot portion of North 19th Avenue between Baxter Road and West Oak Street, in the City of Bozeman, Montana. That said Commission Resolution No. 2982 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 662, the estimated cost of said improvements and the method of assessing the same against the property of the district; and WHEREAS, the notice of the passage of Commission Resolution No. 2982 was duly published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by U.S. mail to each person, firm or corporation having property within the proposed district at his or its last known address, upon the same date that such notice was first published as aforesaid, and due proof having been made of the publication and service of said notice; and WHEREAS, within the time provided by law and said published and served notice, there was not sufficient protest against the creation of said proposed Special Improvement District No. 662. The City Commission was in regular session on the 5th day of July 1994, at 7:00 o'clock p.m. at the Commission Chamber in the City Hall Building in the said City of Bozeman, Montana. The same was the time and place for passing upon all protests, if any, against the proposed work or against the creation of said district; and, it further appears that all of the proceedings for the creation of said district have been lawful and regular; and WHEREAS, the City Commission hereby finds and declares that the public interest and convenience require the creation of the special improvement district; and that all properties within the district are especially benefited by construction of these improvements and will be enhanced in value to the extent of the assessments to be levied upon such properties. -.-..- _0"" - . -...- ,- u ~---~ - NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That the said Special Improvement District No. 662 of the City of Bozeman is hereby created for the purpose of making improvements as set out in Commission Resolution No. 2982 and hereinafter described. Section 2 That said special improvements are hereby ordered to be made in Special Improvement District No. 662, as set forth in Commission Resolution No. 2982: FOR THE ENGINEERING, CONSTRUCTION, INSPECTION AND ENGINEERING CERTIFICATION OF ASPHALT CEMENT PAVING, GRAVEL BASE COURSES AND SUBGRADE PREPARATION, CURB, GUTTER AND SIDEWALKS, STORM DRAINAGE AND ALL NECESSARY APPURTENANCES TO CONSTRUCT A 2,691- FOOT PORTION OF NORTH 19TH A VENUE BETWEEN BAXTER ROAD AND WEST OAK STREET, IN THE CITY OF BOZEMAN, MONTANA. Section 3 That the territory and property included within the limits and boundaries so fixed and described in said Commission Resolution No. 2982 is hereby declared to be the district. Section 4 That the cost and expense to the property owners of the above referenced improvements in said Special Improvement District No. 662 shall be assessed against the entire district. Each lot, block, tract or parcel of land within the district boundary will be assessed for that portion of the whole cost in proportion to the lineal feet abutting or bordering said street improvements. The total actual assessable lineal feet of frontage within the entire district is 5,590.07 lineal feet and is the lineal feet of frontage on which all assessments will be figured.
