COMMISSION RESOLUTION NO. 3001
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, CREATING EXTENDED SPECIAL IMPROVEMENT DISTRICT NO.
663 FOR STREET IMPROVEMENTS FOR THE ENGINEERING DESIGN.
CONSTRUCTION, INSPECTION AND ENGINEERING CERTIFICA TION
OF
ASPHAl T CEMENT PAVING. GRAVEL BASE COURSES AND SUBGRADE
PREPARATION. CURB, GUTTER AND SIDEWALKS. STORM DRAINAGE AND
All NECESSARY APPURTENANCES TO CONSTRUCT
A 1,642-FOOT
PORTION OF WEST OAK STREET. FROM THE WEST EDGE OF NORTH 19TH
AVENUE WEST, IN THE CITY OF BOZEMAN, MONTANA.
WHEREAS, at a regular session of the City Commission of the City of Bozeman,
Montana, held on the 11 th day of July 1994, the City Commission duly passed Commission
Resolution No. 2987, declaring it to be the intention of said City Commission to create a Special
Improvement District to be known and designated as Extended Special Improvement District No.
663 for street improvements for the engineering design, construction, inspection and engineering
certification of asphalt cement paving, gravel base courses and subgrade preparation, curb,
gutter and sidewalks, storm drainage and all necessary appurtenances to construct a 1,642-foot
portion of West Oak Street, from the west edge of North 19th Avenue west, in the City of
Bozeman, Montana. That said Commission Resolution No. 2987 is on file in the office of the
Clerk of the Commission for the City of Bozeman, Montana, and is hereby referred to and made
a part hereof for further particulars in respect to the boundaries of said Extended Special
Improvement District No. 663, the estimated cost of said improvements and the method of
assessing the same against the property of the district; and
WHEREAS, the notice of the passage of Commission Resolution No. 2987 was duly
published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general
circulation printed and published in the City of Bozeman, Montana, and by sending a copy of
such notice by U.S. mail to each person, firm or corporation having property within the proposed
district at his or its last known address, upon the same date that such notice was first published
as aforesaid, and due proof having been made of the publication and service of said notice;
and
WHEREAS, within the time provided by law and said published and served notice, there
was not sufficient protest against the creation of said proposed Extended Special Improvement
District No. 663. The City Commission was in regular session on the 1 st day of August 1994,
at 7:00 o'clock p.m. at the Commission Chamber in the City Hall Building in the said City of
Bozeman, Montana. The same was the time and place for passing upon all protests, if any,
against the proposed work or against the creation of said district; and, it further appears that all
of the proceedings for the creation of said district have been lawful and regular; and

WHEREAS, the City Commission hereby finds and declares that the public interest and
convenience require the creation of the special improvement district; that said special
improvement district is of more than local or ordinary benefit, which requires said district to be
an extended district; and that all properties within the district are especially benefited by
construction of these improvements and will be enhanced in value to the extent of the
assessments to be levied upon such properties.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the said Extended Special Improvement District No. 663 of the City of Bozeman
is hereby created for the purpose of making improvements as set forth in Commission Resolution
No. 2987 and hereinafter described.
Section 2
That said special improvements are hereby ordered to be made in Extended Special
Improvement District No. 663, as set forth in Commission Resolution No. 2987:
FOR THE ENGINEERING DESIGN, CONSTRUCTION, INSPECTION
AND
ENGINEERING CERTIFICATION OF ASPHALT CEMENT PAVING, GRAVEL
BASE COURSES AND SUBGRADE PREPARATION, CURB, GUTTER AND
SIDEWALKS, STORM DRAINAGE AND ALL NECESSARY APPURTENANCES
TO CONSTRUCT A 1,642-FOOT PORTION OF WEST OAK STREET. FROM
THE WEST EDGE OF NORTH 19TH A VENUE WEST. IN THE CITY OF
BOZEMAN. MONTANA.
Section 3
That the territory and property included within the limits and boundaries so fixed and
described in said Commission Resolution No. 2987 is hereby declared to be the district.
Section 4
That the entire cost and expense of the above referenced improvements in said
Extended Special Improvement District No. 663 shall be assessed against the entire district.
Each lot, block, tract or parcel of land within the district boundary will be assessed for that
portion of the whole cost which its area bears to the area of the entire district, exclusive of
streets, avenues, alleys, public places. and open spaces.
The total actual assessable area within the entire district is 3,921,144 square feet and
is the area on which all assessments will be calculated.

a regular session thereof held on the 22nd day of August 1994.
