RELEASE OF DEED RESTRICTION AGREEMENT
City of Bozeman Affordable Housing Program
WHEREAS, in consideration of receiving financial support from the City of Bozeman for the
purchase of real property located at 3195 Mistral Way,Bozeman,Montana,on December 19,2019,
Jarod A. Breitstein (the "Recipients") entered into a Deed Restriction Agreement with the City of
Bozeman, recorded as document No. 2669584 of the official records of the Gallatin County Clerk
and Recorder, Gallatin County, Montana; and
WHEREAS, the real property subject to the Deed Restriction Agreement is described as follows:
Lot 8 in Block 5 of West Winds SW Subdivision P.U.D., City of Bozeman, Gallatin
County, Montana, according to the official plat thereof on file and of record in the office
of the County Clerk and Recorder, Gallatin County, Montana. [JU-640]
WEST WINDS SW SUB, S 02, T 02 S R 05 E, BLOCK 5 LOT 8 ACRES 0.08538, PLAT
J-640
and
WHEREAS, term of the Deed Restriction Agreement continued until the repayment of all funds
subject to a Deed of Trust recorded as Document No.2669584 of the official records of the Gallatin
County Clerk and Recorder, Gallatin County, Montana; and
WHEREAS, the City of Bozeman, as Lender, entered into a Promissory Note with Recipients as
Borrowers dated December 19,2019, promising to pay the loan referred to in the Deed Restriction
Agreement upon its maturity; and
WHEREAS, on March 30, 2023, upon the Recipients sale of the above described real property,
the City received payment in the amount of $52,378.00 pursuant to the requirements of the
aforementioned Deed of Trust and Promissory Note.
NOW THEREFORE, I, Gregory S. Sullivan, pursuant to my authority as city attorney for the City
of Bozeman, Montana, and my authority as Trustee under the aforementioned Deed of Trust,
declare the Deed Restriction Agreement and the Promissory Note to be fully satisfied and no longer
of any force or effect, and that the restrictions of said Deed Restriction Agreement are hereby
terminated.

FULL RECONVEYANCE
I, Gregory S. Sullivan, Bozeman City Attorney, pursuant to my authority as Trustee under that
certain Deed of Trust executed by Jarod A. Breitstein, as Grantors, and the City of Bozeman, as
Lender and Beneficiary, recorded as Document No. 2669584 of the official records of the Gallatin
County Clerk and Recorder, Gallatin County, Montana, hereby declare all indebtedness secured
by said Deed of Trust has been fully paid and satisfied and having Lender and Beneficiary state to
me that all sums and obligations secured by said Deed of Trust have been paid and having the
Lender and Beneficiary surrender the Deed of Trust and note to me for cancellation, do hereby
cancel said note and reconvey,without warranty, to the persons legally entitled therefore,the trust
property now held by me as Trustee under said Deed of Trust covering real property situated in
Gallatin County, Montana described as follows:
Lot 8 in Block 5 of West Winds SW Subdivision P.U.D., City of Bozeman, Gallatin
County, Montana, according to the official plat thereof on file and of record in the office
