I would like to see the city manager and city attorney start enforcing ARTICLE 3. - RULES OF THE
ROAD specifically when it comes to the vast expanse of urban campers we now have living on our
streets. In particular, Sec. 36.03.010. - Safe, properly equipped vehicles required. As I drive by these
urban campsites, some of these vehicles are not safe nor are they properly equipped. Some have
flat tires. Some have busted out tail lights and headlights. Some are immovable objects littering our
streets.
I call on our city manager and city attorney to direct the Bozeman Police Department to go to these
urban campsites that litter our streets and audit these vehicles. If the vehicle is found to be in non-
compliance of Section 36.03.010 it is not a safe or properly equipped vehicle and needs to be
immediately removed/impounded. Enforce your laws and cease following the 2018 legal landscape
concerning how municipalities in the 9th Circuit regulate camping or “sit, sleep, lie” ordinances in
their jurisdictions. Other municipalities don’t have this ‘urban camping’ problem and are enforcing
their municipal codes.
Sec. 20.02.020. – covers camping on city property with permits required. My assumption is that the
city streets are city property and or under the control of the city but if my assumption is wrong – you
can stop here and proceed no further with this paragraph. Section 20.02.020 states, “It is unlawful
for any person to camp on any property belonging to or under the control of the city without having
first secured from the city a written permit so to do”. My question is this. Are these urban campers
securing a permit from the city to camp on our streets? If they are not securing a permit from the
city then they are in violation of Section 20.02.020 and this needs to be addressed. Further, if
Section 20.02.020 has been repealed which pertains to permit required, application, fee and
issuance conditions, this was a grave mistake with no forethought and I call on the city to overturn
this. (This being the fact that 20.02.020 has been repealed).
