Date: Oct 13, 2023; Time: 8:50 AM Sustainability Board: I am writing to thank the Sustainability Board (SB) for its thoughtful discussion of the City's proposed UDC update and for the SB's willingness to suggest to the Community DevelopmentBoard that language be added to the proposed UDC update to better protect Bozeman's natural environment (e.g., trees, water, and other natural resources/sensitive lands). Also, I want to acknowledge SB member Douglas Fischer for giving voice to the view of many—if not most— Bozeman residents that the proposed UDC update should be opposed in its entirety until residents are given more time for substantive input. Especially, I appreciated the SB's discussion about the pros and cons of removing the phrase "to the extent possible" from UDC Sec. 38.410.010. General standards. B. Natural environment: "The design and development of all land uses must be properly related to topography, and must, to the extent possible, preserve the natural terrain, natural drainage, existing topsoil, trees and other existing vegetation" (proposed UDC update, page 4-18). That the phrase "to the extent possible" renders the rest of Sec. 38.410.010.B unenforceable is an issue that I and others have raised previously with City Commissioners and City planners. However, the SB's Oct 11 discussion of this issue was the most frank, in-depth, and public of which I am aware. Again, my thanks to the SB for its thoughtful discussion of the City's proposed UDC update. And, my thanks to the SB for all the work it does to foster environmental sustainability in and for the Bozeman community as a whole. Daniel Carty 213 N.
