HomeMy WebLinkAbout7 Electric Powerline Easement 2051456 Paps: 1 of 1 1111111111111111111111111111111111111111111111111111111 10/2512001 04:06P Shelley Vanoe—Gallatin Cc Mt MISC 6.00 ELECTRIC POWERLINE EASEMENT DOUGLAS LANCE SMITH of Bozeman, Montana, "Grantor", in consideration of $10.00 and other good and valuable consideration, in hand paid, the receipt of which is hereby acknowledged, does hereby grant and convey to THE MONTANA POWER COMPANY, a Montana corporation, of 40 East Broadway, Butte, Montana 59701-9394, and to its successors, assigns, and apportionees, an easement 20 feet in width upon which to construct, operate, maintain, upgrade, replace and remove an electric powerline, communications system and necessary appurtenances and any guy wires, which may extend beyond the easement width, over, under, along and across that certain real property located in Gallatin County, Montana, and particularly described as follows: TOWNSHIP 2 SOUTH, RANGE 5 EAST, P.M.M. SECTION 3: W'/2; A strip of land being 20 feet in width with the centerline of said strip lying 45' east of the west north-south sixteenth line and running generally north-south between Baxter Lane and Durston Road, excepting that portion located within Minor Subdivision #253 which was previously conveyed by Douglas Lance Smith to Christ the King Lutheran Church on December I t, 1998 and recorded at 10:47 AM on December 11, 1998 in Book 192 of Deeds, Page 2264, records of Gallatin County, State of Montana. TOGETHER with reasonable right of ingress and egress from the easement area over lands of the Grantor using existing roads and trails where practicable, and the right to use and keep the easement area free and clear of any and all obstructions or structures, except fences; and the right to clear and IImo` remove all timber, brush, or vegetation from the easement area and to cut and remove such timber, brush I� and vegetation outside the easement that may in Grantee's opinion endanger the powerline, communications system, necessary appurtenances or guy wires.
