On Friday October 6 an individual who said he was on the Bozeman Community Development Board questioned
me about my home. I live at 417 W Koch St. I believe the individual is Henry Happel, though he did not give me his
name. He told me that he was taking an inventory of homes in the neighborhood that did not meet city building code
requirements. I asked him why he was doing this and he replied that many homes were not to the current code. It
seemed as if he wanted to use such information to bolster the city’s argument for adopting the proposed new unified
development ordinance, though he wasn’t really clear about his intentions. He did tell me that my home was in
violation of the city’s height ordinance according to the current code which was news to me. Having built the house
in 2017 and having gone through the permitting process with the city, I was surprised that someone representing the
city would be casually engaging citizens with his unmeasured opinions. To my knowledge and I assume the city‘s,
this house meets the current code requirements.
Let me clear, I do not want my home to be used to further any arguments over the proposed height changes
represented in the new zoning plan. The individual who represented himself as an agent of the city has no idea what
the height of the structure is and I don’t believe he should be conducting an informal “inventory” based on false
assumptions and then using such assumptions to further an argument for increasing building heights according to the
proposed zoning change.
