A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA,PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS
TRACTS OF LAND,HEREINAFTER DESCRIBED,TO THE CORPORATE LIMITS OF
THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE
CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACTS,KNOWN AS
THE CANYON GATE ANNEXATION,APPLICATION 21337.
WHEREAS,the City of Bozeman received a petitionfor annexation from Canyon Gate
Investors,LLC requestingtheCity Commission toextend theboundaries of the City of Bozeman
so as to include an area of and containingapproximately 25.42 acres,located northeastof the
corner of Story MillRoad and Bridger Canyon Drive;and
WHEREAS,an annexation staff report was prepared in accordance with the
Commission's goalsand policiesforannexationand was presentedtotheCommission on December
21,2021;and
WHEREAS,a publicmeeting on saidannexationpetitionwas duly noticedand held on
December 21,2021;and
WHEREAS,on December 21,2021,the Commission receivedtheexecuted annexation
agreement addressingallrecommended terms of annexation;and
WHEREAS,the provisionof availableservices,including,but not limitedto,streets,
rights-of-way,easements,water rightsor cash-in-lieu,waivers ofprotestagainstcreationof SID's,
and water and sewer hookup fees,to saidcontiguoustractsas describedisthe subjectof a written
agreement between theCityand the Landowner;and

WHEREAS,on December 21,2021,theCommission directedrevisionstotheannexation
agreement priortoadoption;and
WHEREAS,on March 1,2022,a revised annexation agreement executed by the
Landowner was presentedtotheCommission;
WHEREAS,on April 5,2022,a furtherrevisedannexation agreement executed by tbe
Landowner was presentedtotheCommission;and
WHEREAS,the Bozeman City Commission hereby finds thatthe annexation of this
contiguoustractisinthe bestinterestsofthe City of Bozeman and theinhabitants/ownersthereof.
NOW,THEREFORE,BE IT RESOLVED by the City Commission of the City of
Bozeman,Montana,to wit:

That itishereby dechred that,pursuantto Title7,Chapter 2,Part46,Mont.Codes Ann.,the
following-describedproperty,which is contiguous to the municipal boundaries of the City of
Bozeman,be annexed totheCityof Bozeman and thatthe boundariesof saidCityshallbe extended
so as to embrace and includesuch approximately25.42 acres,towit:
