Subject: Overturn the approval of Sundance Springs project #22047

Dear Bozeman Mayor and City Commissioners:
We urge you to overturn the approval of the Site Plan on Sundance Springs
Neighborhood Services Lot 2, Project #22047. It threatens our neighborhood by
completely ignoring our Covenants, Developmental Guidelines, and the Sundance
Springs Planned Unit of Development (which we understand has been “lost” by the City).
We encourage you to visit Lot 2 and just imagine as you look at the surrounding homes
and Sundance Springs Open Space and trail system how devastating two commercial
buildings, large outdoor patios, fire pits and inadequate parking on just 1.3 acres will be to
our quiet, safe neighborhood and trail system. The proposed project does nothing to
serve our local needs as intended in the Neighborhood Services Property Covenants.
Instead the project will be a destination location for outdoor dining, drinking and
entertainment! The Covenants, Developmental Guidelines and PUD do not allow outdoor
activities.
It will bring a high volume of traffic to our narrow streets which have no curbs, no street
lights and are maintained and plowed with funds from our SSROA dues. Please overturn
this project for the safety of our neighborhood children, adults and seniors.
Project #22047 is so large that they propose to use unapproved access to numerous trails
owned and maintained by Sundance Springs homeowners. Only homeowners can grant
access to our open space which requires a 2/3 approval vote.
We urge you to overturn the approval of the almost complete disregard for our PUD’s
mandated Architectural Guidelines that maintain the residential character of Sundance
Springs Neighborhood Services. The purpose of the design theme is to blend in with the
residential character of the surrounding development. The two proposed commercial
buildings are non-compliant with the PUD, the Final Approved Master Plan and
Covenants.
Please overturn the approval of Project #22047. There are over 200 written public
comments opposing this site plan. The 1.3 acres of land could easily be developed to
provide the neighborhood services as stated and illustrated in the Neighborhood Services
Property Covenants as noted in the Commission’s Finding of Fact and Order from 1996.
