WAIVER OF RIGHT TO PROTEST
CREATION OF SPECIAL IMPROVEMENT DISTRICTS
YELLOWSTONE THEOLOGICAL INSTITUTE MINOR SUBDIVISION
The undersigned owner of the realpropertysituatedin the County of Gallatin,Stateof
Montana,and more particularlydescribedas follows:
A tractof land being the SW1/4NW1/4 and the NW1/4SW1/4 of Section 24,
Excepting therefrom thatportion conveyed to the Stateof Montana in Bargain and
Sale Deed recorded June 30,1964 in Book 146 of Deeds,Page 24,Records of
GallatinCounty,locatedin the NW1/4 and SW1/4 of Section 24,Township 2 South,
Range 5 East,P.M.M.,City of Bozeman,GallatinCounty,Montana,being more fully
describedas follows:
Beginning at the NW 1/16 corner of said Section 24,thence along the West lineof
C.O.S.252 S 01'07'36"Wa distanceof 1322.36 feetto the C-W 1/16 corner of said
Section 24,said point also being the Northwest corner of C.O.S.792;thence along
the West lineof C.O.S.792 and the West lineof the Platof Alder Creek Subdivision,
Phase 5,respectively,S 00o59'23"Wa distance of 1329.61 feet to the SW 1/16
corner of said Section 24;thence along the North lineof the SW1/4SW1/4 of said
Section24 N 89644'49"Wa distanceof 1300.07 feetto a point on the East right-of-
way line of South 19th Avenue;thence along said right-of-way line the two (2)
following courses;1)N 00002'55"Ea distanceof 152.86 feet;2)N 00035'25"Ea
distance of 2508.45 feetto a point on the South line of Lot 3,South University
DistrictPhase I;thence along the South lineof saidLot 3 S 89620'00"Ea distanceof
1323.14 feetto the Point of Beginning.Said tractcontaining in area 79.983 Acres,
along with and subjectto any easements.
IN CONSIDERATION of receivingapproval forsubdivisionofthe subjectpropertyfrom
the Cityof Bozeman,along with accompanying rightsand privilegesand forotherand valuable
consideration,the receiptof which ishereby acknowledged,and in recognitionof the impacts
which willbe caused by the development of the above-describedproperty,the owner has waived
and does hereby waive foritself,itssuccessorsand assigns,forevertherightto protestthe
creationof a one or more specialimprovement districtsfor;
a.Streetimprovements to Graf Streetincludingpaying,curb/gutter,sidewalk,and
storm drainage
b.Streetimprovements to S.19thAvenue including paying,curb/gutter,sidewalk,
and storm drainage
c.Streetimprovements to S.15thAvenue including paying,curb/gutter,sidewalk,
and storm drainage
d.Streetimprovements to Arnold Streetincludingpaying,curb/gutter,sidewalk,and
storm drainage
e.Intersectionimprovements to S.19thAvenue and Graf Street
f.Intersectionimprovements to Graf Streetand S.11thAvenue
g.Intersectionimprovements to S.19thAvenue and Stucky Road
h.Intersectionimprovements to S.19m Avenue and Kagy Boulevard;
or to make writtenprotestagainstthe size or area or creationof the districtto be assessedin
response to a duly passed resolutionof intentto createone or more specialimprovement districts
which would includethe above-describedproperty.
In the event an SID isnot utilizedforthe completion of theseimprovements,the developer
agreestoparticipatein an alternatefinancingmethod forthe completion of saidimprovements
on a fairshare,proportionatebasisas determined by square footage of property,taxable
valuationof the property,trafficcontributionfrom thedevelopment or a combination thereof.
This waiver ismade forthe benefitofthepropertydescribedhereinshallbe a covenant
running with the land.
The terms,covenants and provisionsof thiswaiver shallextend to,and be binding upon the
successors-in-interestand assignsof the
