City of Bozeman Community Development Division ATTN: Anna Bentley Dear Ms. Bentley, My wife and I have lived in Bozeman since 1980. We were among the original owners of a lot in the Sundance Springs Subdivision. Although we no longer own that Sundance lot, we are writing in opposition to approval of Site Plan #22047 based on the City's incompetence in maintaining development records and the City's apparent disregard for precedent and BMCs. Specifically the City lost the following Sundance Springs PUD documents: Folder Z-95125: Approved Preliminary PUD Master Plan Folder Z-9812: Approved Final PUD Master Plan, Approved Final Development Guidelines, and Conditions of Approval. In lieu of the above documents, the City is ad libbing the approval for Site Plan # 22047. For example, The Village Store listed in the Sundance PUD Master Plan has morphed from a single 5,000 sq foot retail space into a two-store, two-story 12,000 sq foot monstrosity with inadequate parking, inadequate setbacks, full basement (specifically disallowed due to high water table), and industrial architecture all jammed into a residential neighborhood. Lack of onsite parking will encourage illegal street parking in the adjacent neighborhood which has 24 foot wide streets. This auto congestion is a recipe to increase emergency response vehicle time. Site Plan # 22047 allows 3,000 square feet of outside seating with music for patrons of the proposed Coal Blower's Brewery. The associated noise will destroy the tranquility of the neighborhood. Furthermore, the associated Brewery traffic will add to the vehicular congestion on South Third and present a hazard to the students of Sacajawea Middle School (eg., many breweries open at noon!). In our opinion, the City is violating multiple portions of the Bozeman City Codes to accommodate developers. Perhaps the City thinks sacrificing the residential character of neighborhoods, impairing public safety, and allowing an attractive nuisance is a necessary price to pay for increased business tax revenue?
