Easements
1. BMC 38.410.060: Easements
Mutual accesses easements for lot aggregation.
The 10' utility easement is shown on revised sheet XX.
Stormwater
1. BMC 38.410.080 and 40.04.500.A: Requirements to control and reduce stormwater
pollutants
a. The stormwater design report is attached.
b. The groundwater elevation as the site is estimated at six feet below the surface per
Gallatin County GIS Hackett and Slage Contours. The revised retention area is
one foot in depth.
Transportation
1. BMC 38.400.090.D.2 Access
a. Public access location was approved and recorded on Amended Plat of Lot 4,
Block 12 Cattail Creek Subdivision Phases 2A and 2B in 2007.
Water Rights
1. BMC 38.410.130—Water Rights
a. Griffin Nielsen was contacted on October 13, 2021 and stated that the existing
credit for Blkl2, Lots 4A and 4B is sufficient to cover the project annual demand.
No LILWR payment is required. Email correspondence from Nielson is attached.
Water and Sewer
1. BMC 38.410.070—Municipal water, sanitary sewer and storm sewer system
a. Water and sewer main extensions are provided onsite.
2. DSSP V.A.4—Water Main Size
a. The water main size has been revised to 8" DIP on the attached plan set.
3. DSSP V.B.10—Sewer Main Size
a. The sewer main size has been revised to 8" PVC on the revised plan set.
4. BMC 38.410.070 and DSSP V.A and V.B
a. An estimate of the peak-hour sanitary sewer demand as well as the average and
max day demands of domestic water usage for the proposed site development
certified by a professional engineer are attached.

Project Location: Cattail Creek Subdivision Phase 2, Block 12, Lot 4A & 4B
Project Description: Site Plan application for four 2-household residential buildings on two separate
lots.
Recommendation: The DRC review finds that the project does not comply with the requirements of
the Bozeman Municipal Code and is deeming the application inadequate for further review. Code
corrections must be satisfied prior to continued review. All references are to the Bozeman Municipal
Code (BMC).
Section 2— RECOMMENDED CONDITIONS OF APPROVAL
Please note that these conditions are in addition to any required code provisions identified in this
report. These conditions are specific to the development.

1. Sec. 38.320.020. - Form and intensity standards elements.
a. The current layout with the three 2-unit buildings on the south of the lot triggers
38.320.020E.2 and must be reoriented so that there are only two buildings that both
have frontage on the adjacent streets. This has been discussed with the applicant prior
to the writing of this memo.

ENGINEERING COMMENTS:
Easements
1. BMC 38.410.060: Easements
a. The applicant must recorded the mutual access and drainage easements covering both
properties and provided a copy of the recorded document prior to site plan approval or
complete a lot aggregation.
b. The civil plans are unclear if the 10 utility easement, indicated on the plat, is shown.
Please clarify the plans/change the line type prior to approval.
1. BMC 38.410.080 and 40.04.500.A: Requirement to control and reduce stormwater pollutants
a. The stormwater design report must be provided demonstrate that proposed
development meets or exceeds the City's drainage requirements. If the development
indents discharge drainage to subdivision infrastructure the design report must include
the relevant sections of the subdivision design report demonstrating that the
subdivision infrastructure was design to accommodate runoff from the proposed
development.
b. The maximum groundwater elevations must be included in the stormwater report and
should be vetted by the engineering certifying the drainage design. Additionally, the
subsurface systems are proposed to be deeper than the 3.5ft from the existing ground.
Storage proposed below the seasonal high will not be considered in meeting the City's
storage requirements.

1. BMC 38.400.090.D.2 - Access
a. Table 38.400.090-1-The proposed access does not meet the City' separation
requirements from Downy Lane. The access must align with Downy Lane or meet
the City's access separation requirements. The applicant may apply for a
modification to this requirement and follow guidance in the Bozeman Municipal
Code (BMC), Section 38.400.090.H.

1. BMC 38.410.130 - Water Rights: The applicant must contact Griffin Nielsen with the City
Engineering Department to obtain a determination of cash-in-lieu of water rights (CILWR).
CILWR must be paid prior to site plan approval.
Water and Sewer
1. BMC 38.410.070- Municipal water, sanitary sewer and storm sewer system: A water and
sewer main extensions must be provided onsite.
2. DSSP V.A.4-Water Main Size: The minimum diameter for any new main is 8-inch, unless
specific approval in writing is obtained from the City of Bozeman for smaller diameters.
3. DSSP V.13.10- Sewer Main Size: The minimum diameter of a sewer main is 8-inches. Main lines
shall be sized for design flow, not available slope. PVC pipe shall be used for all gravity flow
main lines unless other materials are specifically approved.
4. BMC 38.410.070 and DSSP V.A and V.B - Water and Sewer Design Criteria: Prior to a
determination of adequacy the applicant must provide an estimate of the peak-hour sanitary
sewer demand as well as the average and max day demands of domestic water usage for the
proposed site development. The estimates must be certified by a professional engineer.

Future Impact Fees - Please note that future building permit applications will require payment of the
required transportation, water, sewer and fire impact fees according to the City of Bozeman adopted
impact fee schedule in place at the time of building permit issuance. If you desire an estimate of the
required impact fees according to current rates please contact the Department of Community
Development and/or visit.
Note: During preparation of the staff report, additional conditions of approval may be recommended
based on comments and recommendations provided by other applicable review agencies involved
with the review of the project.
