COMMISSION RESOLUTION NO. 3058 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, STATING THE CITY'S INTENT TO AMEND THE LAND USE ELEMENT OF THE 1990 BOZEMAN AREA MASTER PLAN UPDA TE ON APPROXIMA TEL Y 320 ACRES GENERALLY BOUNDED BY FERGUSON A VENUE ON THE EAST, U.S. HIGHWAY 191 ON THE SOUTH, COTTONWOOD ROAD ON THE WEST AND DURSTON ROAD ON THE NORTH TO COMPLY WITH EXISTING ZONING DESIGNATIONS. WHEREAS, Planning staff has processed an application for a Master Plan Amendment to amend the land use element of the 1990 Bozeman Area Master Plan Update from "Urban Residential" on the property along U.S. Highway 191 between Ferguson Avenue and Cottonwood Road, currently zoned Business Park, to "Business Park/lndustrial"; and from "Suburban Residential" on property currently zoned R-C, B~1, PL!, R-1 and B-2 in the west half of the west half of Section 10, and north of the Business Park zoned property, to "Urban Residential"; and WHEREAS, the Planning staff assessed the application in light of the criteria set forth for review of Master Plan Amendments; and WHEREAS, the City-County Planning Board conducted a public hearing on an application for at its regular meeting held on April 4, 1995, taking into careful consideration the criteria set forth for review of Master Plan Amendment applications; and WHEREAS, the City~County Planning Board found that this area received Zone Map and Master Plan map amendments in 1980, at the time approximately 500 acres west of Ferguson Avenue was rezoned. The Master Plan was updated in 1983, and a majority, but not all, of the land use designations were continued; and WHEREAS, the City-County Planning Board found that the 1990 Bozeman Area Master Plan Update eliminated the Business Park (Technology Research) Master Plan designation and designated the entire area for residential development, even though the zoning on the property remained Business Park; and WHEREAS, the City-County Planning Board found that there are seven zoning and two Master Plan designations in this area. The proposed amendment would cause the Master Plan designation to be in compliance with the BP, Business Park, R-O, Residential--Office, R-1, Residential--Low-density, and B-1, Neighborhood Service, zoning designations. The existing B-2 zoning would still not be in compliance with the Master Plan; and the City-County Planing Board found that development of this B-2 zoned property for commercial use should be considered on a case-by-case basis. At that time, it would be determined whether a potential development did or did not comply with the Master Plan; and .----.-----. ----.- ~..- ....- . ..- ...'-- , ""!I"''''' -----... '.'~.,: . WHEREAS, subsequent to its public hearing, the City-County Planning Board voted, on a vote of 7 to 0, to forward a recommendation of approval. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that it intends to revise the Master Plan to amend the land use element of the 1990 Bozeman Area Master Plan Update on the approximately 320 acres generally bounded by Ferguson Avenue on the east, U.S. Highway 191 on the south, Cottonwood Road on the west and Durston Road on the north to comply with existing zoning designations, more particularly described as follows: from "Urban Residential" on the property along U.S. Highway 191 between Ferguson Avenue and Cottonwood Road, currently zoned Business Park, to "Business Park/Industrial"; and from "Suburban Residential" on property currently zoned R-O, B-1, PU, R-1 and B~2 in the west half of the west half of Section 10, and north of the Business Park zoned property, to "Urban Residential" .
