Re: running amok on private property
Hello Yellowstone Fiber,
I am disappointed to see Yellowstone Fiber disturbing private property without the permission of the
owner. You have installed conduit on at least three sides of Woodbrook property. The atached photos
and sketch show one of the loca�ons.
Some background: I am the president of Woodbrook Townhouses Owners Associa�on (WTOA).
Woodbrook and Yellowstone Fiber had a previous mee�ng regarding Yellowstone Fiber accessing
Woodbrook property. The result of the mee�ng was that Woodbrook would contact Yellowstone Fiber IF
Woodbrook choose to request the installa�on of Yellowstone Fiber’s conduit. Woodbrook has NOT
requested that Yellowstone Fiber install the conduit. (That ac�on is s�ll under considera�on by
Woodbrook.)
Despite the agreement decided in the mee�ng Yellowstone Fiber choose to install conduit at it’s own
voli�on; there has been no coordina�on with Woodbrook. In addi�on, and perhaps more galling, there
is no apparent effort to mi�gate the consequences of installing the conduit. Some of the issues that I
no�ce are:
• Uncovered/improperly covered holes in the ground
• Clean-up that is lacking or not complete
• Disturbances to exis�ng landscape
• Poten�al long term street damage due to ‘plugging’ cored holes in asphalt with concrete (dis-
similar materials)
• Sidewalk damage
I have cc’d the Engineer of Record as well as the City of Bozeman. My reason for doing so is to let those
en��es know of my concern AND to request that they exert control over this process.
NOTE: I understand that Yellowstone Fiber has an agreement with the city of Bozeman to install conduit
in u�lity easements. There are certain u�lity easements shown in Woodbrook’s plats but, at least in the
case of the intersec�on Mason and Tracy, Yellowstone Fiber has installed conduit outside of those
easements.
I write this leter as a private ci�zen but that my previous contact with Yellowstone Fiber was to
represent Woodbrook as the WTOA president.

ATTACHMENT TO LETTER OF 21 JULY 2023
A) PARTIAL PLAT OF WOODBROOK AT MASON AND TRACY
This is a par�al plat at the intersec�on of Mason and Tracy. Easements are indicated by dashed lines (see
green highlight). There is no easement at the intersec�on.
B) PICTURE OF SIDEWALK AND CONDUIT AT MASON AND TRACY (1 OF 2)
Item 1 shows sidewalk panel has been removed
Item 2 shows dirt near top of culvert at Mathew Bird Creek (no silt / erosion control to avoid silt
in Mathew Bird Creek)
Item 3 shows damage to grass at South side of sidewalk. This area is a likely erosion path.
C) PICTURE OF SIDEWALK AND CONDUIT AT MASON AND TRACY (2 OF 2)
Item 1 is damaged sidewalk panel (Note: this area accumulates water and then freezes to ice in
the winter�me – it is a hazard to pedestrians).
Item 2 shows destroyed vegeta�on leading to an erosion pathway to Mathew Bird Creek.
D) PICTURE OF CORE DRILLED HOLE IN STREEET (TRACY)
Item 1 is a concrete plug in the core-drilled hole in Tracy. The road material is asphalt. The concrete plug
is not at street level – this is a place for water to accumulate and will lead to freeze/thaw damage. Also,
the paving surface is asphalt…. Is is proper design to plug the hole with a dis-similar material (concrete)?
