HomeMy WebLinkAbout23 - Release of Deed Restriction Agreement - Courtney Dresden and Jacob Martin - 2398 West Beall StreetWhen recorded returnto: Bozeman City Attorney'sOffice PO Box 1231 2802437 Bozeman,MT 59771-1230 (g|pgg7g7 PM Fee 00 11||||11111||ll11111111|I|l11111111|||||||||||||||||||1111111||Illllllllllllllllli RELEASE OF DEED RESTRICTION AGREEMENT City of Bozeman Affordable Housing Program WHEREAS,in considerationof receivingfinancialsupport from the City of Bozeman for the purchase of realpropertylocatedat2398 West BeallStreet,Bozeman,Montana,on December 14, 2018,Courtney Dresden and Jacob Martin (the "Recipients")entered into a Deed Restriction Agreement with the City of Bozeman,recorded as Document No.2634021 of the officialrecords of the GallatinCounty Clerk and Recorder,GallatinCounty,Montana;and WHEREAS.the realpropertysubjectto the Deed RestrictionAgreement isdescribedas follows: Lot 9B,Block 3 of the West Babcock Subdivision,a tractof land locatedin theNE 1/4, Section 11,Township 2 South,Range 5 East,P.M.M.,City of Bozeman,GallatinCounty, Montana,according to the officialplatthereofon fileand of record in the officeof the County Clerk and Recorder of GallatinCounty,Montana.[PlatJ-l89A] ;and WHEREAS,term of the Deed RestrictionAgreement continued untilthe repayment of allfunds subjecttoa Deed ofTrustrecordedas Document No.2634021 oftheofficialrecordsofthe Gallatin County Clerk and Recorder,GallatinCounty,Montana;and WHEREAS,the City of Bozeman,as Lender,entered intoa Promissory Note with Recipientsas Borrowers dated December 14,2018,promising topay the loan referredto intheDeed Restriction Agreement upon itsmaturity;and WHEREAS,on April 19,2023,upon theRecipientssaleof the above-describedrealproperty,the City received payment in the amount of $10,000.00 pursuant to the requirements of the aforementioned Deed of Trust and Promissory Note. NOW THEREFORE,I,Gregory S.Sullivan,pursuanttomy authorityas cityattorneyforthe City of Bozeman,Montana,and my authorityas Trustee under the aforementioned Deed of Trust, declaretheDeed RestrictionAgreement and thePromissory Note tobe fullysatisfiedand no longer of any force or effect,and thatthe restrictionsof said Deed RestrictionAgreement are hereby terminated.
