Cash-in-lieu of Water Rights

Please find the enclosed request for determination of Cash-in-lieu of Water Rights for Aaker
Phase 1 Subdivision. We are about to submit the Preliminary Plat application, and this will
require a Cash-in-lieu determination.
Aaker Phase 1 Subdivision creates 5 lots for subsequent residential and mixed-use development.
The subdivision also dedicates public rights-of-way, and a large public park parcel.
The subdivision improvements consist of the public street improvements and park improvements.
As part of the subdivision improvements Kagy Boulevard will be widened and extended and will
have landscaping installed with street improvements.
We are proposing that the individual lots will each pay their own Cash-in-lieu of Water Rights at
the time of Site Plan review, when development and irrigation needs are known. So they are not
considered in the subdivision payment.
The Aaker Phase 1 park, as well as future phase parks in the Parks Master Plan will be irrigated
by a single exempt water right with three wells. One well will be for the Phase 1 park and two are
in planned future phase parks. All wells and the exempt water right will be owned and operated
by the City.
The only City water required for the subdivision improvements is for the irrigation of the
landscaping along Kagy Boulevard and the eastern side of South 23rd Avenue. The estimated
irrigation requirement for these boulevards is 1,689,301 gallons per year or 5.18 acre-feet. An
irrigation plan for the subdivision boulevards and open spaces is provided as sheet L 601.
Can you please review this information and confirm the Cash-in-lieu of Water Right amount due
for the subdivision improvements? I have attached the irrigation plans for the subdivision
improvements to assist with your review.
