Resource Technologies, Inc. (RTI) prepared this Phase I Environmental Site Assessment
(ESA) Report of the 95.6-acre parcel located at 2250 West Kagy Boulevard in Bozeman,
Montana for University West, LLC. The purpose of this ESA was to identify, to the
extent feasible, adverse environmental conditions present on the Property. This report
summarizes the methods, results, and conclusions arrived at during this investigation.
Findings in this report reflect information available to RTI at the date of this report. Any
use of this report by a third party, or any reliance on or decisions based on this report, are
the responsibilities of such third parties. RTI accepts no responsibility for damages, if
any, suffered by any third party as a result of decisions made or actions based on this
report.
The conclusions provided by RTI are based solely on the information presented in this
report. Additional information that was not readily available to RTI at the time of this
report may result in a modification of the conclusions presented.
This Phase I ESA was conducted by, or under the supervision of, an individual that meets
the ASTM definition of an Environmental Professional (EP). The credentials of the EP
and other key RTI personnel involved in conducting this Phase I ESA are provided in
Appendix G.
We declare that, to the best of our professional knowledge and belief, we meet the
definition of Environmental Professional as defined in §312.10 of 40 CFR Part 312. We
have the specific qualifications based on education, training, and experience to assess a
property of the nature, history, and setting of the subject property. We have developed
and performed the all appropriate inquiries in conformance with the standards and
practices set forth in 40 CFR Part 312.

EXECUTIVE SUMMARY
Resource Technologies, Inc. (RTI) completed this Phase I Environmental Site
Assessment (ESA) of the vacant agricultural property located at 2250 West Kagy
Boulevard in Bozeman, Montana (referred to as the “Property”) under authorization from
Conner Brown on behalf of West University LLC. RTI performed the ESA in
conformance with the scope and limitations of American Society for Testing and
Materials (ASTM) Practice E1527-13, and the U.S. Environmental Protection Agency
(EPA) Standards and Practices for All Appropriate Inquiries {40 CFR Part 312}(AAI).
The objective of the Phase I ESA was to evaluate the property for indications of ASTM
Recognized Environmental Conditions (RECs), Controlled Recognized Environmental
Conditions (CRECs), and/or Historical Recognized Environmental Conditions (HRECs)
in connection with the Property.
The Property occupies approximately 95.6 acres of undeveloped land and has been
historically used for pasture and cultivated crops. It is bounded on the north and west by
land owned by Montana State University, to the southeast by South 19th Avenue, to the
south by Stucky Road. The northeastern portion of the site borders newer apartment
building, offices, a bank and law firm. The Property is in the southern part of Bozeman
which is experiencing an influx of residential subdivisions and office complexes
developed on land that was historically occupied by rural farmsteads and agricultural
fields.
The Property use does not include the storage of hazardous substances and petroleum
products. There are no RECs, HRECs, or de minimis conditions associated with current
or past operations at the Property.
An environmental records search was performed and identified sites within their
respective ASTM E1527-13 search radii of the Property that may represent RECs,
HRECs, or de minimis conditions. Based on one or more of the following reasons:
distance from the Property, position of site with respect to assumed groundwater flow
direction, the native soils, and regulatory status; none of the adjacent sites identified in
the environmental records search report are expected to affect soil, groundwater, or air
quality at the Property. The environmental records search identified no REC, HRECs or
de minimis conditions at or near the Property.
RTI observed the adjacent properties from the Property or nearby public rights-of-way.
The Property is adjacent to apartments, commercial office buildings, banks and a law

firm. The Bozeman Agricultural Research and Teaching Farm (BART Farm) that is part
of Montana State University and operated by the College of Agriculture is located to the
north and west of the Property. No indications of RECs, HRECs or de minimis
conditions were observed in connection with the current uses of adjacent properties that
are likely to have affected the Property.
In summary, RTI did not identify any RECs associated with the Property during this
assessment.

1.0 INTRODUCTION
Resource Technologies, Inc. (RTI) completed this Phase I Environmental Site
Assessment (ESA) of the 95.6-acre parcel of vacant land located at 2250 West Kagy
Boulevard, west of South 19th Avenue in Bozeman, Montana (the “Property”) at the
request of Conner Brown representing West University, LLC (the “Client). The work
was performed with authorization from the Client in accordance with the agreement
between the Client and RTI.
1.1 Purpose
The purpose of this ESA was to identify, to the extent feasible, adverse environmental
conditions at the Property. The objective of the ESA was to perform appropriate inquiry
into the past ownership and uses of the Property consistent with good commercial or
customary practice as outlined by American Society for Testing and Materials (ASTM)
Standard Practice for Environmental Site Assessments: Phase I Environmental Site
Assessment Process (E1527-13).
ASTM E1527-13 indicates that the purpose of the Phase I ESA is to identify Recognized
Environmental Conditions (RECs), including Historical Recognized Environmental
Conditions (HRECs), and Controlled Recognized Environmental Conditions (CRECs)
that may exist at a property.
A REC is defined as the presence or likely presence of any hazardous substance or
petroleum product in, on, or at a property: (1) due to any release to the environment; (2)
under conditions indicative of a release to the environment; or (3) under conditions that
pose a material threat of a future release to the environment.
An HREC is defined as a past release of any hazardous substance or petroleum product
that has occurred in connection with the property and has been addressed to the
satisfaction of the applicable regulatory authority or meeting unrestricted use criteria
established by a regulatory authority without subjecting the property to any required
controls (for example, property use restrictions, activity and use limitations, institutional
controls, or engineering controls). If the past release is considered to be a REC at the time
the ESA is conducted, the condition shall be included in the conclusions section of the
ESA as a REC.
A CREC is defined as a REC resulting from a past release of hazardous substances or
petroleum products that has been addressed to the satisfaction of the applicable regulatory

authority (for example, as evidenced by the issuance of a no further action letter or
equivalent, or meeting risk-based criteria established by regulatory authority), but with
hazardous substances or petroleum products allowed to remain in place subject to the
implementation of required controls (for example, property use restrictions, activity and
use limitations, institutional controls, or engineering controls). If the condition is
considered to be a CREC, it shall be included in the findings section of the ESA as a
REC.
De minimis conditions are not RECs. The term includes hazardous substances or
petroleum products even under conditions in compliance with laws. As indicated, the
term REC does not include de minimis conditions, which generally do not present a
material risk to human health and would not likely be subject to enforcement action if
brought to the attention of governmental agencies.
1.2 Scope of Work
The ESA involved on-site reconnaissance, a review of available historical and regulatory
records, topographical maps, and aerial photographs, and interviews with persons
knowledgeable about the history of the Property. This report summarizes the methods,
results, and conclusions arrived at during this investigation and provides a detailed
account of property history including ownership and use.
The scope of work did not include an assessment for environmental regulatory
compliance of any facility ever operated at the Property or sampling and/or analyses of
environmental media. The conclusions presented in this ESA Report are professional
opinions based on data described herein. The opinions are subject to the limitations
described in Section 1.4.
1.3 Special Terms, Conditions, and Significant Assumptions
This report will help West University, LLC qualify under the innocent landowner defense
related to Comprehensive Environmental Response, Compensation, and Liability Act
(CERCLA) liability. Specifically, the intent is to document “all appropriate inquiry into
the previous ownership and uses of the property consistent with good commercial or
customary practice” as defined in 42 USC Section 9601(35) (B).
The conclusions provided will assist the Client in evaluating the environmental risks
associated with the Property. However, as required by law, it is the responsibility of said
entities and their legal counsel to determine, based on their experience and sophistication,
whether additional information is required in order to meet the investigation burdens
placed on real estate owners by State and Federal law.

1.4 Exceptions and Limiting Conditions
Our findings, including the summary and conclusions reflect conditions at the Property at
the date of this report. The conclusions are based on a review of public records made
available to RTI personnel regarding prior and existing site conditions as well as a site
visit and investigation. This Phase I ESA did not involve a compliance audit of the
Property or reporting of current practices at the Property. Please note that no
environmental investigation can warrant that a site is free of contamination.
The conclusions provided by RTI are based solely on the information presented in this
report. Additional information that was not readily available to RTI at the time of this
report may result in a modification of the conclusions presented. The RTI work included
review of information provided by others; therefore, RTI assumes no responsibility for
conditions not revealed or observed during the investigation, or for conditions not
generally recognized as environmentally unacceptable at the time this report was
prepared. Information and conclusions provided herein apply only to the Property as it
existed during RTI's reconnaissance. Should Property use, or conditions change,
information and conclusions contained herein may no longer apply.
Work was performed in accordance with ASTM E1527-13. Any deviations from this
practice are as noted in this report.
2.0 PROPERTY DESCRIPTION
The Property is located on the west side of South 19th Avenue between West Lincoln
Road and Stucky Road. The Client identified the address as 2250 West Kagy Boulevard.
The Property occupies approximately 95.6 acres of undeveloped land and has been
historically used for pasture and cultivated crops. Two small creeks and an irrigation
ditch run south to north on the Property.
The Property has been in the Aaker family since 1917. It has been farmed since before
that time. A house was located where the Stockman Bank is currently located (northwest
corner of South 19th Avenue and West Kagy Boulevard). According to the current owner
(Steven Aaker) this house was present when his family purchased the land in 1917. Both
Steven Aaker and his father Ralph Aaker were born and raised in the home. According
to Steve Aaker, the farm outbuildings were located just to the south of the house. These
buildings are no longer present. The land where the house and outbuildings were located
were sold and redeveloped within the past two decades and are not the focus of this site
investigation.

According to Steve Aaker, his family farmed the land until the 1950s and then MSU
leased the land for their agricultural experiment station for approximately 20 years. Since
that time, the Property has been leased to and farmed by Dusenberry Farms.
The legal description for the Property is Minor Sub 191B, S14, T02 S, R05 E, Lot 2A,
Acres 95.639, Remainder Lot. A site location map of the Property is included as Figure 1.
A site layout plan of the Property is provided as Figure 2. The Property is in south
Bozeman which has seen considerable redevelopment of agricultural land into residential
and business subdivisions.
2.1 Physical Setting
Physical setting records are evaluated to determine if the physical setting may have
contributed to adverse environmental conditions in connection with the Property. A
United States Geological Survey (USGS) 7.5 Minute Topographic Map was reviewed to
determine the topographic characteristics of the Property. The area of interest of the
USGS map was used for the base of Figure 1.
According to the topographic map series, the Property is situated in the southeast quarter
of Section 14, Township 2 South, Range 5 East, M.M.P. in Gallatin County, Montana.
The geographical coordinates are Latitude: 45.6593920, Longitude: -111.068868.
2.1.1 Property Topography and Surface Water Flow
The land surface is generally level at approximately 4927 feet above sea level. The
Middle Creek Ditch Lateral runs through the middle portion of the Property from south to
north. Two small creeks also run south to north on the Property. The eastern-most creek
is the East Fork of East Catron Creek and the western-most creek is the West Fork of
East Catron Creek. The nearest larger natural surface water is Bozeman Creek which is
located approximately 1.6 miles to the east. The creeks flow north towards the East
Gallatin River which is located approximately 3.5 miles to the north.
2.1.2 Regional and Property Geology
The Property lies within the Bozeman Fan, an alluvial fan with its head along the north
front of the Gallatin Mountain Range. Fan deposits range in thickness from
approximately 200 feet at the head to less than a hundred feet where the fan deposits
interfinger with fluvial deposits of the Gallatin and East Gallatin Rivers. The surficial
geology in the vicinity of the Property is the Alluvial Fan older (Qafo). The alluvium
consists of angular and subangular, locally derived gravel in a coarse sand and granule
matrix with clast size ranging from pebble to small boulder. Maximum thickness
probably about 150 feet (Vuke, et al, 2014).

Based on information obtained through the Natural Resources Conservation Service,
Web Soil Survey (websoilsurvey.nrcs.usda.gov/app/ accessed 8/14/21), there are four
major soil series for the Property. The Turner loam (457A) covers approximately 53.4
percent of the Property and is well drained on slopes 0 – 2 percent. This series is derived
from alluvium and generally located on stream terraces. Water movement in the most
restrictive layer is moderately high to high. The Blossberg loam (542A) covers 21.6
percent of the Property and is poorly drained on 0 - 2 percent slopes. This series is also
from alluvium and general located on stream terraces. Water movement in the most
restrictive layer is moderately high to high. The Meadow Creek loam (510B) covers
approximately 15.1 percent of the Property. The soil is somewhat poorly drained on
slopes 0 - 4 percent, derived from alluvium and generally located on stream terraces.
Water movement in the most restrictive layer is moderately high to high. The Hyalite-
Beaverton soil series (448A) covers 9.9 percent of the Property and is well drained on
slopes 0 – 2 percent. This series is derived from alluvium and generally located on
stream terraces. Water movement in the most restrictive layer is moderately high. A soils
map with general soil descriptions is included in Appendix A. Soil information is also
included in the EDR Radius Map in Appendix D.
2.1.3 Regional and Property Hydrogeology
Regional groundwater flow direction is to the north-northwest. Groundwater recharge
from rainfall, snowmelt and stream and irrigation ditch leakage occurs to the east and
north near the Gallatin Range front (Hackett et al., 1960). Based on well data for the
area, local shallow groundwater is expected to flow north-northwest parallel to the
Gallatin River.
Based on review of well logs from nearby groundwater wells and review of the EDR
Radius Report, depth to groundwater near and at the subject property is expected to be
between 6 and 15 feet. Depth of shallow groundwater generally varies depending on the
time of year and seasonal precipitation events. Site-specific groundwater depth and flow
direction were not determined through direct measurement during this assessment. Well
log reports obtained from Montana Ground Water Information Center (MGWIC)
database for wells located on the Property are included in Appendix A. Information
related to nearby wells are included in the EDR Radius Report (Appendix D).
3.0 SITE RECONNAISSANCE
Pam Blicker of RTI conducted the site reconnaissance on August 17, 2021. Access
consent was provided through Conner Brown with West University, LLC. Weather
conditions at the time of the site visit were hazy with a temperature of 80 degrees

Fahrenheit. There were no weather-related property access restrictions encountered
during the site visit. Figures 1 and 2 provide information about the Property and
adjoining properties. Photographs collected during the Property visit are included in
Appendix B.
3.1 Site Reconnaissance Methodology
The Property reconnaissance focused on observation of current conditions and observable
indications of past uses and conditions that may indicate the presence of RECs. The
Property reconnaissance was conducted on foot. RTI traversed the boundary areas and
interior to observe the Property:
3.2 General Site Setting and Vicinity Characteristics
The Property is approximately 95.6 acres and is currently used for livestock grazing and
grain crops. The Property has been used for agriculture since before 1917. No structures
are present on the site and according to interviews and available historical records (see
Section 6) there have never been structures on the Property. The only infrastructure
present are fences and irrigation ditch (Middle Creek Ditch Lateral). An irrigation ditch
also runs along the east side of South 19th Avenue.
The surrounding land has historically been used for agriculture with a few rural
residential and outbuilding structures interspersed. Over time, the areas to the northeast
and south have been developed into office complexes, multi-family residential units,
churches and a bank. Agricultural operations are still present to the east and west.
Bordering the west and northwest portion of the Property is the Bozeman Agricultural
Research and Teaching Farm (BART Farm) that is part of Montana State University
(MSU) College of Agriculture.
3.3 Exterior Observations
The Property is relatively level and several areas are fenced. Figure 2 shows the fences
and what each area was being used for at the time of the site visit. The western most area
is occupied by the MSU BART Farm. A fenced area separates this portion of the
Property from the large center barley field. The area is used for cattle grazing, cattle
were present at the time of the site visit. The West Fork of East Catron Creek runs south
to north through this section. This small creek had a trickle of water flowing with areas
of standing water. The larger barley field in the center portion of the Property is partial
fenced and bordered on the east by the irrigation ditch. This irrigation ditch was running
with water but not near capacity.

Two test pits that are likely related to upcoming development at the Property were
observed in the southern portion of the southeast quarter of the Property. No information
was available for these test pits at the time of the report.
No signs of dumping or historic structures were observed during the site visit. No signs
of stressed vegetation or stained soil was observed.
RTI made the following specific observations during the Property reconnaissance of the
exterior areas of the Property and/or identified the following information during the
interview or records review portions of the assessment.

3.4 Interior Observations
There are no permanent structures located on the Property.
3.5 Hazardous Substances and Petroleum Products
RTI did not observe storage of hazardous substances or petroleum products at the
Property. The following table summarizes RTI’s observations during the Property

3.6 Current Uses of Adjoining Properties
A visual survey of the surrounding area was conducted by observation from the Property
and/or from public rights-of-way during the reconnaissance. Land use adjoining the
Property consists of the following:

Mr. Aaker was interviewed by telephone on August 19, 2021.
The Property has been in the Aaker family since 1917. Mr.
Aaker grew up on the farm in a house that was located on the
original farmstead. He indicated that there were no USTs, only
an AST while his family was farming. The house and buildings
on the original farmstead were razed in in the late 1990s or early
2000s and these areas have been developed into multi-unit
residential dwellings and business complexes.

5.3 Vapor Encroachment Screening
RTI completed a Vapor Encroachment Screening for the Property in compliance with
ASTM Standard Guide for Vapor Encroachment Screening on Property Involved in Real
Estate Transaction (ASTM E-2600-15). Because there is no known subsurface
contamination beneath the Property, a vapor encroachment condition does not exist.
6.0 HISTORICAL USE INFORMATION
The objective of consulting historical sources of information is to develop the history of
the Property and surrounding area to evaluate if there are past uses that may have resulted
in RECs. During the review of historical records, RTI attempted to identify uses of the
Property from the present to the Property’s first developed use. RTI’s research included
the reasonably ascertainable and useful records described in this section.
The original boundaries of the Property were defined as the southeast quarter of Section
14. Starting in the late 1990s, land in the northeast quarter of the southeast quarter has
been sold and subdivided. Development includes multi-family residential units, office
buildings and a bank. Development continues in this area. A small portion of the
northern part of the southeast quarter of the original property has also changed ownership
and been subdivided (Figure 2). These areas are no longer part of the original Property
and are not included in the focus of this Phase I ESA. The remaining part of the
southeast area of the Property is used for grain crops and livestock grazing.
The crop land is flood irrigated using water from the Middle Creek Ditch Lateral. Mr.
Aaker indicated that the head gates located on the Property were recently upgraded and
irrigation occurred this year. According to the historical aerial photographs, the crop land
has been irrigated for many decades.
6.1 Aerial Photographs
The general type of activity on a property and land use changes can often be discerned
from the type and layout of structures visible in the photographs. However, specific
elements of a facility’s operation usually cannot be discerned from aerial photographs
alone. RTI retained EDR to search for historical aerial photographs for the Property and
vicinity. The EDR report is included in Appendix D.

6.2 Fire Insurance Maps
Fire insurance maps are produced by private insurance map companies and can indicate
property use at a specific date of the Property and surrounding properties. The
information is obtained for research of the historical use of the Property and as supporting
data for other historical inquiries. RTI retained EDR to search for copies of historical fire
insurance maps covering the Property and immediately adjacent properties. The EDR
Sanborn Map Report is provided in Appendix E. There is no coverage of the Property and
adjacent area.
6.3 Property Tax Records
RTI reviewed information from tax records on the Gallatin County website
((https://itax.gallatin.mt.gov/, accessed 7/29/21). The listed owner for the Property is
Steven R. Aaker. The assessor code for east parcel is RGG40140 (geocode 06-0798-14-
4-02-20). No environmental concerns were identified on the tax statement (copy provided
in Appendix C).
6.4 Land Title Records
RTI obtained ownership records available through the Gallatin County Clerk and
Recorders office. Copies of the deed documents that RTI obtained are provided in
Appendix C. RTI examined available recorded land title records and found no record of
actions of environmental concern appended to the property deeds. However, the
ownership records reviewed may not have included all the previous or current parties that
may have or had an interest in the property. In addition, it is unknown whether the
property was leased or subjected to other actions which may have caused environmental
impact beyond the operations reviewed. Associated recorded land title records were not
reviewed by RTI for completeness or continuity. The table below summarizes the
ownership information obtained by RTI.

6.5 Historical Topographic Maps
RTI retained EDR to research historical topographic maps obtained through USGS. The
maps help identify past Property usage and areas of potential environmental concern. No
environmental concerns were identified on the maps. The EDR report of the historical
maps are included in Appendix E. The following table summarizes the maps reviewed

information regarding businesses or residences historically associated with the property
of concern. Recognizing previous businesses provides the environmental professional
with insight to potential environmental impacts caused by historic facilities. RTI retained
EDR to research available reverse city directories for the Property, in approximate five-
year intervals dating back to 1979. Records for South 19th Avenue and West Kagy
Boulevard were documented. No occupants listed are expected to pose a risk for the
Property and therefore, no RECs were identified through City Directory research. The
EDR report is provided in Appendix E. The following table is a summary of RTI’s

6.7 Building Department Records
RTI researched building department records through the Gallatin County website
(http://webapps.gallatin.mt.gov/mappers/, accessed 8/12/21). No permits were identified
for the Property.
6.8 Zoning/Land Use Records
RTI reviewed the current zoning map through the Gallatin County website
(www.gis.gallatin.mt.gov/webmaps/, accessed 8/23/21). The Property is currently zoned
agricultural suburban (AS). The property type listed on the Property Record Card is
Vacant Land – Rural (VAC-R)
6.9 Other Historical Sources
RTI searched the Montana Cadastral website (www.svc.mt.gov/msl/mtcadastral, accessed
7/29/21). There are no listed dwellings, commercial buildings or other outbuildings/yard
improvements for the Property (copies of the Property Record Cards are included in
Appendix C).
The Montana Cadastral website was also researched to identify construction dates for the
buildings on the adjacent properties. The original farmstead located on the east edge of
the original parcel (quarter section) was razed between 1995 and 2002. The bank located
at the NE corner of West Kagy Boulevard and South 19th Avenue was constructed in this
area in 2004. The Law Firm located near the SE corner of West Kagy Boulevard and
South 19th Avenue was constructed in 2014. A rental property was located at this site
from the early 1980s until approximately 2013. Construction to the south including the
church and commercial properties started in the late 1990s.
7.0 USER PROVIDED INFORMATION
RTI was contracted solely to the Client, who is considered a “User” of this ESA as
defined in ASTM E1527-13. This report may only be by University West, LLC and their
assigns; collectively referred to as the Users. Any reliance on this report by another party
shall be at such party's sole risk.
ASTM E1527-13 describes responsibilities of the User to complete certain tasks in
connection with the performance of “All Appropriate Inquiries” into the Property. Conner
Brown completed a User Questionnaire for the Property on behalf of University West
LLC. His responses are summarized in the following sections. A copy of the
questionnaire is provided in Appendix F.

7.1 Environmental Liens or Activity and Use Limitations
Under the ASTM standard it is the responsibility of the Users to verify whether any
environmental liens exist with regard to the Property, and to provide this information to
the environmental professional preparing the assessment.
The Users did not have actual knowledge of any environmental liens or activity and use
limitations (AULs) encumbering the Property, or in connection with the Property. No
environmental liens or AULs were identified for the Property through RTI’s review of
the current deeds. Copies of the current deeds are included in Appendix C.
7.2 Specialized Knowledge
Mr. Brown indicated that he has been associated with the development of the adjacent
properties for several years and has not witnessed any use other than farming on the
Property.
7.3 Valuation Reduction for Environmental Issues
Mr. Brown indicated that the purchase price was within the normal values with no
environmental issues.
7.4 Commonly Known or Reasonable Ascertainable Information
Mr. Brown was aware of the past uses of the Property as agriculture. He was not aware of
specific chemicals that are present or once were present, or any spills or other chemical
release.
7.5 Obvious Indicators of Contamination
Mr. Brown has no knowledge of obvious indicators of contamination that indicate the
presence or likely presence of a release at the Property.
7.6 Other Information
The User informed RTI that the reason why the Phase I ESA is being performed is to
meet normal due diligence for purchasing the Property.
8.0 NON-SCOPE CONSIDERATIONS
The focus of the Phase I ESA was to assess the potential for general environmental
problems and/or liabilities resulting from past or current uses of the Property and adjacent
properties. As a result, this assessment did not address the presence of or the potential
liabilities associated with the following non-scope conditions, unless they were the

express concerns of contacted persons, cited reports and literature authors, or the agreed
upon scope of services: asbestos-containing materials, radon, lead-based paint, lead in
drinking water, wetlands, regulatory compliance, cultural and historic resources,
industrial hygiene, health and safety, ecological resources, endangered species, indoor air
quality, biological agents, or mold.
No ASTM E1527-13 non-scope services were performed as part of this Phase I ESA.
9.0 EVALUATION
This section provides a summary overview of our findings, opinions, and conclusions.
9.1 Findings and Opinions
Information gathered from interviews, existing data review, and a property inspection
was evaluated to determine if RECs are present in connection with the Property. Based
on this information, RTI made the following findings and developed the following
opinions.
Finding 1: The Property occupies 95.6 acres of undeveloped land and has been
historically used for pasture and cultivated crops. There are no structures on
the Property and research and interview results indicate none have been
located on the Property since at least 1917. The Property is in the southern
part of Bozeman which has seen much commercial and residential
development over the past decade.
Opinion 1: There are no indicators of leaks, spills, or other releases on the Property.
There are no outbuildings and no chemicals or petroleum products are stored
on the Property. There are no RECs, HRECs, or de minimis conditions
associated with current or past operations at the Property.
Finding 2: The surface of the site is generally level and housekeeping practices are very
good. There are areas that are fenced and the boundary area is partial
fenced. There are no indications of surface staining, debris piles or other
abandoned materials at the site.
Opinion 2: No signs of contamination were observed at the site. There are no RECs,
HRECs, or de minimis conditions associated with the physical setting of the
Property.
Finding 3: An environmental records search was performed to identified sites within
their respective ASTM E1527-13 search radii of the Property that may
represent RECs, HRECs, or de minimis conditions.

Opinion 3: Based on one or more of the following reasons: distance from the Property,
position of site with respect to assumed groundwater flow direction, the
native soils, and regulatory status; none of the nearby sites identified in the
environmental records search report are expected to affect soil, groundwater,
or air quality at the Property. The environmental records search identified no
REC, HRECs or de minimis conditions at or near the Property.
Finding 4: RTI observed the adjacent land from the Property or nearby public rights-of-
way. The MSU Agricultural Experiment Station (BART) covers 474 acres
to the north and west of the Property. Bordering the northeast portion of the
Property are apartment buildings, commercial offices, a church and a bank.
To the east is agricultural land and to the south are more commercial
business structures and a large church. Agricultural land is located
southwest of the Property.
Opinion 4: No indications of RECs, HRECs or de minimis conditions were observed in
connection with the current uses of adjacent properties that are likely to
have affected the Property.
9.2 Data Gaps
40 CFR §312.10(a) and ASTM E1527-13 identify a “data gap” as the lack or inability to
obtain information required by the standards and practices of the rule despite good faith
efforts by the Environmental Professional or the User.

10.0 CONCLUSIONS
RTI has performed this Phase I ESA of the Property in general conformance with the
scope and limitations of ASTM Practice E1527-13 of the 95.6-acre Property located at
2250 West Kagy Boulevard in Bozeman, Montana. Any exceptions to, or deletions from,
this practice are described in previous sections of this report. This assessment has
revealed no evidence of recognized environmental conditions in connection with the
Property.

Physical Setting Information
Soil Types and Properties
Erosion factor K indicates the susceptibility of a soil to sheet and rill erosion by water. Factor K is one of six factors used
in the Universal Soil Loss Equation (USLE) and the Revised Universal Soil Loss Equation (RUSLE) to predict the
average annual rate of soil loss by sheet and rill erosion in tons per acre per year. The estimates are based primarily on
percentage of silt, sand, and organic matter and on soil structure and saturated hydraulic conductivity (Ksat). Values of K
range from 0.02 to 0.69. Other factors being equal, the higher the value, the more susceptible the soil is to sheet and rill
erosion by water.
"Erosion factor Kw (whole soil)" indicates the erodibility of the whole soil. The estimates are modified by the presence of

The U.S. Department of Agriculture’s (USDA) Natural Resources Conservation Service (NRCS) leads the national
Conservation Soil Survey (NCSS) and is responsible for collecting, storing, maintaining and distributing soil
survey information for privately owned lands in the United States. A soil map in a soil survey is a representation
of soil patterns in a landscape. Soil maps for STATSGO are compiled by generalizing more detailed (SSURGO)
soil survey maps.

USFS property. Conducted phytostabilization study for BLM that included greenhouse
and field plot studies to determine effectiveness of reclaiming and revegetating acid
metalliferous mine tailing sites.
Stormwater Management: Developed, submitted and managed over 20 stormwater
construction permits in Montana. Team member for 3 research projects funded by MT
DOT designed to evaluate commonly used and newly developed erosion control methods
on steep slope highway cuts.

incorporating client-specified requirements. Provides technical support for voluntary
cleanup of contaminated properties and brownfields assessment.
Environmental Permitting & Regulatory Compliance: Provides evaluation and assistance
in environmental impacts, water quality, wetlands delineation, permitting operations, and
stormwater and wastewater management.
Prior to joining RTI, McDevitt established McDevitt Associates; was a partner with
