This document provides the information required in BMC 38.220.060.A.8. The Aaker property has 3 water courses running south to north through the property. The West Fork of Catron Creek, a natural stream, flows through the western portion of the property. The East Fork of Catron Creek, also a natural stream, runs through the eastern portion of the property. A Middle Creek Ditch irrigation ditch, a man-made ditch, flows through the center of the Aaker property. All 3 water courses can be considered agricultural water facilities. The Aaker property lies on the southern side of Bozeman, and as such is towards the downstream end of the agricultural water supply system. There is only one water user downstream of Aaker, which is the MSU BART Farm. However, the existing water courses allow unused irrigation water (irrigation wastewater) from upstream to return to natural water courses and are important to the overall agricultural water system. Once on the MSU property a large portion of this ditch water is diverted to the West Fork of Catron Creek, and then pumped out for spray irrigation. A small portion of the water continues downstream for flood irrigation and stock water. Only minor changes to the agricultural water user facilities are proposed for Aaker Phase 1 Subdivision, and there will be no reduction in quality or amount of irrigation water. Within the Bozeman area the historic network of irrigation ditches presents a significant flood hazard to developed property. This is because the irrigation ditches captured flood flows from natural drainages, were routed along high areas to facilitate flood irrigation, and they were sized to convey only irrigation water and not potential flood flows. South of the Aaker property the West Fork of Catron Creek drainage basin has been intercepted and diverted into the center irrigation ditch. The Aaker project is proposing to install a diversion pipe returning non-irrigation water, irrigation wastewater, and flood flows back to the West Fork of Catron Creek in the southern portion of the Aaker property. Prior to the diversion a headgate will be installed allowing MSU irrigation water to continue downstream in the existing irrigation ditch, but preventing unused irrigation wastewater and flood flows from continuing north. The only other alteration is the extension of an existing culvert, with the same size pipe, where Kagy Boulevard crosses the center irrigation ditch. The northern portion of the West Fork of Catron Creek will flow through the Phase 1 City Park. The northern portion of the center irrigation ditch is located on Common Open Space. The remaining water courses will remain as is on the large, restricted lot south of Kagy. Stormwater from subdivision improvement is retained on-site, with large event overflows returning to the two natural streams. No stormwater is discharged into the center irrigation ditch. All natural stream crossings and the return pipe are sized to convey the 100-year flood flow, which exceeds any irrigation water flow. Planned alterations have been presented to Middle Creek Ditch Company and MSU and have initial concurrence. A letter affirming this is provided with the Preliminary Plat submittal. Formal approval will be obtained prior to Final Plat and easements will be granted to the Middle Creek Ditch Company with the Final Plat. A 30’ wide easement is proposed for the return pipe, and a 20’ wide easement is proposed for the center irrigation ditch. Proposed easements are shown on the Preliminary Plat and subdivision plan sheets.
