Bozeman,MT 59718 as the owner of the followingdescribedrealproperty:
Lot R-1 of theJ&D Family Major Subdivision,Phase 1,Located inthe SE %of Section9,
Township 2 South,Range 5 East,M.P.M.,Cityof Bozeman,GallatinCounty,Montana,
accordingto the officialsurvey thereofon fileand of recordin theofficeofthe County
Clerk and Recorder of GallatinCounty,Montana [J-502]("ServientTenement")
And hereby grantsa Stormwater Easement forthebenefitof and as appurtenancetothe
followingdescribedparcelsof realproperty:
Lots 1 &2,Block 1 of J&D Family Major Subdivision,Phase 1,Located inthe SE K of
Section9,Township 2 South,Range 5 East,M.P.M.,Cityof Bozeman,GallatinCounty,
Montana,accordingto the officialsurvey thereofon fileand of recordinthe officeof the
County Clerk and Recorder of GallatinCounty,Montana [J-502]("Dominant Tenements")
The purpose ofthe Stormwater Easement isfordetentionof stormwater from theDominant
Tenements in an existingstormwater pond.The Stormwater Easement shallalsoincludethe
rightof accesstothe easement areaforinstallation,repairand maintenance of stormwater
facilities.The Stormwater Easement isone hundred twenty (120')inwidth paralleltothe north
boundary of the ServientTenement as more particularlylocatedand shown on Exhibit"A"
attachedhereto.
Afterinstallationof stormwater facilities,the company working within saideasement shall
promptly and fullyrestorethepropertytopreconstructionconditionto the greatestextent
practicable,possibleand reasonable.In the event saidcompany failsto restoretheproperty,the
partyrequestingand benefittingfrom such facilityinstallationshallassume such responsibility.
As a conditionof use of the Stormwater Easement,theowners of the Dominant Tenements
covenant to indemnify,defend and hold theowner of the ServientTenement harmless from and
againstany and allclaims,demands,losses,damages,liabilities,lawsuitsand otherproceedings,
judgements and awards,and costsand expenses (includingbut not limitedto,reasonable
attorney'sfees)arisingout of or in connection with the use of the Stormwater Easement herein
granted.This Grant of Stormwater Easement shallbe perpetual,shallrun with the land,and
shallbind theheirs,successorsand assignsof the partieshereto.
