TEMPORARY DRAINAGE EASEMENT
J &D Family Limited Partnership,GRANTOR,in considerationof One Dollar ($1.00)and other
good and valuableconsideration,receiptof which isacknowledged,grantsto the&
Bozeman,a municipal corporationof the Stateof Montana,with officesat411 East Main,
Bozeman Montana 59715,GRANTEE,itssuccessorsand assigns,an temporary easement for
publicdrainagepurposes,in,through and acrossthe followingdescribedrealpropertysituatedin
GallatinCounty,Montana,more particularlydescribedas followsand on theattachedExhibit
"L"and Exhibit"M":
The GRANTOR warrantsthatitislawfullyseizedand possessedof the realpropertydescribed
above,thatithas lawfulrighttoconvey theproperty,or any partof it,and thatitwillforever
defend the titleof thepropertyagainsttheclaims of allpersons.The GRANTOR furtheragrees
thatthe GRANTEE may peaceably hold and enjoy therightsand privilegeshereingranted
without any interruptionby the GRANTOR.Both the GRANTOR and GRANTEE agreethatif
and when thepipingof the Baxter Ditch in theNortheastcornerof theNE1/4 of SEl/4,Section
9,T2S,R5E,PMM isin placeand approved,thistemporary drainageeasement isofficially
terminated.
The terms,covenants and provisionsof the easement and agreement shallextend to and be
binding upon theheirs,executors,administrators,personalrepresentatives,successorsand
assignsof thepartieshereto.
