Offer of Dedication
This IrrevocableOffer to Dedicate and Declaration of Restrictions(hereinafter"Offer")is
made thisEday of imi ga 2017,by J&D FAMILY LIMITED PARTNERSHIP,OF
270 AUTOMOTIVE AVE,BOZEMAN,MT 59718 (hereinafterreferredto as "Grantor").
WHEREAS,Grantor isthe legalowner in simple feeinterestof certainrealpropertieslocated
intheCounty of Gallatin,Stateof Montana,and describedas:
Lot 1 of the J&D Family Subdivision,Phase 2,locatedin the SE%of Section9,Township 2
South,Range 5 East,P.M.M.,City of Bozeman,GallatinCounty,Montana,according to the
officialsurvey thereofon fileand of record inthe officeof the County Clerk and Recorder of
GallatinCounty,Montana.(hereinafterreferredto asthe "Property")and
WHEREAS,Grantor appliedto the City of Bozeman (the "Municipality")for approval to
undertake development as defined in Chapter 38.42,BMC within the City of Bozeman (hereinafter
the "Permit");and
WHEREAS,approval of Application#17318 was grantedon
by the Municipalityin accordance with the provisionsof Title38,BMC,hereby incorporatedby
reference;and
WHEREAS,Grantor wishes to meet the requirements of Title38,BMC,to provide public
accessand/orallow simultaneousconstructionof infrastructureand improvements which willlaterbe
grantedto the Municipality,with the buildings,remaining improvements and landappurtenantthereto
toremain inprivateownership,as authorizedin Section38.39.030.C;and
WHEREAS,thewater and sewer improvements and streetinfrastructureappurtenantto and to
be installedor constructedon or under the above describedlands,and infrastructureand/or interests
thereinare to be dedicatedto the Municipality,freeand clearof allencumbrances,pursuantto said
finalapproval of the Permit;and,
WHEREAS,itisintendedthatthisOffer isirrevocableand shall,upon writtenacceptanceby
the Municipalityand finalapproval of the Permit referencedherein,grant allrightsof use or access
formaintenance and repairofthe saidimprovements and infrastructureoffered;
NOW THEREFORE,in considerationof the granting of,and conditioned upon,the final
approval forapplication#17318,the Grantor hereby offersto dedicatetothe Municipality,the sewer
and water improvements and streetinfrastructureconstructedor be constructedupon therealproperty
as specificallysetforth,describedand identifiedin the plansand specificationsissuedor prepared by
GENESIS ENGINEERING INCORPORATED AT 204 North 11n'Avenue,Bozeman,MT.Project
number 1134.003 dated (with subsequent approved revisions),which are by this
referenceincorporatedinthisinstrument.
1.Benefit and Burden.This Offer shallrun with and burden the Property and all
obligations,terms,conditions,and restrictionshereby imposed shallbe deemed tobe covenants and
restrictionsrunning with the land and shallbe,upon theissuanceof the finalPermit referenceherein,
be effectivelimitationson the use and access of the Property by Grantor and shallbind the Grantor
and all successors and assigns.This Offer shallbenefit the Municipality only so long as said
improvements and infrastructuresforsewer and water existon theProperty.
2.Construction and Validity.Ifany provisionof these Restrictionsisheld to be
invalidor forany reason becomes unenforceable,no otherprovisionshallbe thereby affected
or impaired.
3.Successors and Assigns.The terms,covenants,conditions,exceptions,
obligations,and reservationscontained in thisOffer shallbe binding upon and inure to the
benefitof the successors and assigns of both the Grantor and the Municipality,whether
voluntaryor involuntary.
4.Limitations.The constructionand otherstandardsadopted orutilizedby theCity
of Bozeman regarding legalform,constructionmaterials,warranty,and allother elements
relatingto improvements or infrastructureconstructedor be constructedpursuanttothe Permit
shallbe fullyapplicable.
5.Term.This irrevocableOffer of Dedication shallbe binding forthe durationof
FinalSitePlan approvalprocess.Upon writtenacceptanceofthisOffer by theMunicipality,this
Offer and the terms,conditions,and restrictionshereof shallexistin perpetuity,shallhave the
effectof a grantby Grantor,subjectto the conditionsstatedherein,and shallrun with the land
and be binding on the parties,theirheirs,assigns,and successors,PROVIDED,HOWEVER,
thisgrantshallbe nulland void ifthe Permit referencedhereinisnot granted and issuedby the
Municipalityon orbeforeone year afterthe date of FinalPlan approvalorextensionsof thedate
of approval.
