AMENDMENT TO DECLARATION OF RESTRICTIVE COVENANTS
FOR LOW-INCOME HOUSING CREDITS
Recitals
The parties recite and declare:
WHEREAS,Farmhouse Partners-Baxter Limited Partnership and its successors and
assigns(the Owner)and the Montana Board of Housing,an agency of the State of Montana
together with any successor to its rights,duties and obligations,(the Board)have entered into a
Declaration of Restrictive Covenants for Low Income Housing Credits for the project known
as Baxter Apartments dated recorded October 18,2005 with the Gallatin County Clerk and
Recorder,Gallatin County Montana Number 2206102.
WHEREAS,the Board originally determined the Project would support a Credit
allocation in the amount of$507,026.00;and
WHEREAS,it has been found necessary to make a modification as to the covenants
concerning the allocation of tax credits stated as such:
WHEREAS,the Board has now determined the Project would support a Credit
allocation in the amount of$518,500.00;and
NOW THEREFORE,in consideration of the above,the terms and covenants of this
agreement,and other valuable considerations,the receipt of which is acknowledged,the parties
agree as follows:
1. Page lof tax credits allocated to the Declaration of Restrictive Covenants for Low-
Income Housing Credits dated 10/18/05 shall be corrected to state as follows:
WHEREAS,the Board has determined the Project would support a Credit allocation in
the amount of$518,500.00;and
2. All other terms and conditions of said Declaration of Restrictive Covenants For
Low-Income Housing Credits dated 10/18/05 shall remain the same.
In witness whereof,each party to this agreement has caused it to be executed on the date
