AMENDMENT TO SIXTH DECLARATION OF ANNEXATION
TO AMENDED AND RESTATED DECLARATION OF PROTECTIVE
COVENANTS, CONDITIONS AND RESTRICTIONS FOR NORTON RANCH
THIS AMENDMENT TO SIXTH DECLARATION OF ANNEXATION TO
AMENDED AND RESTATED DECLARATION OF PROTECTIVE COVENANTS,
CONDITIONS AND RESTRICTIONS FOR NORTON RANCH (this"Amendment") ismade
effectiveasofthedateofitsrecordingintheOfficialRecordsforGallatinCounty,Montana, by
NORTON PROPERTIES LLC, an Oregon limitedliabilitycompany, andNORTON RANCH
HOMES, LLC, an Oregon limitedliabilitycompany (individuallyand collectively,the
"Declarant").
RECITALS:
A. Declarantcreateda residentialsubdivisionknown asNortonRanch (the
"Subdivision")by recording(a)thatcertainAmended andRestatedDeclarationofProtective
Covenants,ConditionsandRestrictionsforNortonRanch on October 14,2011,as Document
Number 2399078 intheOfficialRecords ofGallatinCounty,Montana (the"Declaration");and
(b)thatcertainplatofNortonEastRanch SubdivisionPhase 1on February 16,2011,as
Document Number 2382592 intheOfficialRecordsofGallatinCounty,Montana.
B. Declarantexpanded the Subdivisionby annexing additionalpropertyintothe
SubdivisioninthatcertainFirstDeclarationofAnnexation toAmended andRestatedDeclaration
ofProtectiveCovenants,Conditionsand RestrictionsforNortonRanch recordedonJune 27,
2013,as Document No. 2453826 intheOfficialRecordsofGallatinCounty,Montana.
C. Declarantfurtherexpanded theSubdivisionby annexing additionalpropertyinto
theSubdivisioninthatcertainSecond DeclarationofAnnexationtoAmended andRestated
DeclarationofProtectiveCovenants,Conditionsand RestrictionsforNortonRanch recordedon
May 12,2014,as Document No. 2480710 intheOfficialRecords ofGallatinCounty,Montana.
D. Declarantfurtherexpanded theSubdivisionbyannexing additionalpropertyinto
theSubdivisioninthatcertainThirdDeclarationofAnnexationtoAmended andRestated
DeclarationofProtectiveCovenants,ConditionsandRestrictionsforNortonRanch recordedon
July1,2015,asDocument No. 2516323 intheOfficialRecords ofGallatinCounty,Montana.
E. Declarantfurtherexpanded theSubdivisionby annexing additionalpropertyinto
theSubdivisioninthatcertainFifthDeclarationofAnnexation toAmended andRestated

F. Declarantfurtherexpanded theSubdivisionby annexingadditionalpropertyinto
theSubdivisioninthatcertainSixthDeclarationofAnnexation toAmended and Restated
DeclarationofProtectiveCovenants,Conditionsand RestrictionsforNortonRanch (the"Sixth
Declaration")recordedon March 30,2018,as Document No. 2609707 intheOfficialRecordsof
GallatinCounty,Montana, which annexedthefollowingdescribedrealproperty(the"Phase 3B
Property")intothe Subdivision:
Lots1 through6,Block 5;Lots1 through 12,Block 6;Lots1 through6,Block 7;Lots2
through7,Block 8;Park IA,Park 2,Park 3A; and Open Space (OS) D and El,asshown
on thefinalplatofNorton East Ranch Subdivision,Phase 3B, filedforrecordinthe
OfficialRecordsofGallatinCounty,Montana.
G. Declarantowns allofthePhase3B Propertyand desirestoamend theSixth
DeclarationtosubjectthePhase3B Propertytoadditionalrestrictionsapplicableexclusivelyto
thePhase3B Propertypursuanttoitsreservedrightsunder ArticleIISection2ofthe
Declaration.
NOW, THEREFORE, Declaranthereby amends theSixthDeclarationasfollows:
1. DefinedTerms.Any capitalizedtermnotdefinedinthisDeclarationof
Annexationshallhavethemeaning ascribedtosuchtermintheDeclaration.
2. RestrictiveCovenants. The Phase3B Propertyshallbe subjecttothefollowing
restrictivecovenantswhich shallbe inadditiontothosesetforthintheDeclaration.
2.1 NotwithstandinganythinginArticleIIISection2D or any otherprovision
oftheDeclarationtothecontrary,allroofsshallbecladwithblackasphalt25-yearshingles,all
exposed raftertailsshallbeconstructedofaminimum 2"x6"dimensionfasciaboard,andthe
fasciaboardon gablesshallbeaminimum dimension of 1"x8". .
2.2 NotwithstandinganythinginArticleIIISection3or any otherprovisionof
theDeclarationtothecontrary,singlefamilyresidentialhouses shallbeaminimum of 1,500
squarefeetinarea,excludinggaragesoroutbuildings.
2.3 NotwithstandinganythinginArticleIIISection3or any otherprovisionof
theDeclarationtothecontrary,allgaragesshallbeattachedand shallbe aminimum areaof484
squarefeetinareaortheminimum arearequiredby theCityofBozeman ifgreater.
3. Miscellaneous.IntheeventofaconflictbetweenthetermsoftheDeclaration
andthetermsofthisDeclarationofAnnexation,theterms ofthisAmendment shallprevailwith
respecttothePhase3B Property.
