Declarantexpanded the Subdivisionby annexing additionalpropertyintothe SubdivisioninthatcertainFirstDeclarationof Annexation toAmended and RestatedDeclaration of ProtectiveCovenants, Conditions and RestrictionsforNorton Ranch recordedon June 27, 2013, asDocument No. 2453826 intheOfficialRecords ofGallatinCounty, Montana. C. Declarantfurtherexpanded the Subdivisionby annexing additionalpropertyinto the SubdivisioninthatcertainSecond Declarationof Annexation toAmended and Restated Declarationof ProtectiveCovenants, Conditions and RestrictionsforNorton Ranch recordedon May 12,2014, asDocument No. 2480710 intheOfficialRecords ofGallatinCounty, Montana. D. NOW, THEREFORE, Declaranthereby declaresthefollowingpursuanttoitsreserved rightsunder Article13ofthe Declaration: 1. Defined Terms. Any capitalizedterm notdefinedinthisDeclarationof Annexation shallhave themeaning ascribedtosuch term intheDeclaration. 2. Annexation. 2.1 The Phase 3C Propertyishereby annexed intothe Subdivisionand shall be held,conveyed, hypothecated,encumbered, used,occupied and improved subjecttotheterms ofthe Declaration.The Phase 3C Propertyshallbe consideredpartofthe "Property" under the Declarationand the platforthePhase 3C Propertyshallbe considereda"Plat"underthe Declaration. 2.2 Lots9 through 16,Block 3;Lots8 through 14,Block 8;Lots 1 through 7, Block 9;and Lots 1 through 8,Block 10withinthePhase 3C Propertyshalleach be considereda "Lot" underthe Declaration,and each owner of thereofshallbe consideredan "Owner" under the Declaration. 2.3 Open Space (OS) C2, DI, E2, and F1 withinthePhase 3C Propertyshall each be considend partof the "Common Areas" under theDeclaration. 3. Noxious Weed Control.The controlof noxious weeds by theAssociationon those areasforwhich theAssociationisresponsibleand thecontrolof noxious weeds by individual Owners on theirrespectiveLotsshallbe assetforthand specifiedunder the Montana Noxious Weed ControlAct (MCA 7-22-2101 through 7-22-2153) and therulesand regulationsofthe GallatinCounty Weed Department. The Associationisresponsibleforcontrolof stateand county declarednoxious weeds inthe Common Areas (such as SubdivisionParks,Open Spaces, community areas,trailsand roadways). Each Owner shallbe responsibleforthecontrolofthe stateand county declarednoxious weeds on hisorherown Lot. Both unimproved and improved Lotsshallbe managed fornoxious weeds. Intheeventan Owner does not controlthe noxious weeds on hisorher own Lot,afterten (10)days'noticefrom theAssociation,the Association may cause the noxiousweeds to be controlled,inwhich casethecostand expense associated with such weed management shallbe assessedagainst,and alien on,thatLot. 4.
