THIS AMENDMENT TO THE AMENDED AND RESTATED DECLARATION OF
PROTECTIVE COVENANTS, CONDITIONS AND RESTRICTIONS FOR NORTON
RANCH ("Amendment"), ismade effectiveas ofthedateofitsrecordingintheOfficial
RecordsofGallatinCounty,Montana, by NORTON PROPERTIES, LLC, an Oregon limited
liabilitycompany, andNORTON RANCH HOMES, LLC, an Oregon limitedliabilitycompany
(individuallyand collectively,the "Declarant").
RECITALS
WHEREAS, Declarantcreatedaresidentialsubdivisionknown as Norton Ranch (the
"Subdivision")by recordingthefollowinginstruments:
A. The finalplatofNorton EastRanch SubdivisionPhase 1,recordedon February 16,2011,
as Document Number 2382592 intheOfficeoftheGallatinCounty Clerkand Recorder;
B. The Norton EastRanch SubdivisionPhase 1DeclarationofCovenants and Restrictions,
recordedon February 16,2011,asDocument Number 2382596 inthe Officeofthe
GallatinCounty Clerk& Recorder;
C. The Amended and RestatedDeclarationofProtectiveCovenants,Conditionsand
Restrictionsfor Norton Ranch, recordedon December 14,2011,as Document Number
2399078 intheOfficeoftheGallatinCounty Clerk& Recorder (the"Restated
Declaration");
D. The finalplatofNorton East Ranch SubdivisionPhase II,recordedon June 27,2013,as
Document Number 2453823 intheOfficeoftheGallatinCounty Clerk& Recorder;
E. The finalplatofNorton East Ranch SubdivisionPhase IIA,recordedon May 12,2014,as

WHEREAS, Declaranthasannexed Phases 1,II,IIA,and 3A intotheSubdivisionand
subjecttothetermsoftheRestatedDeclarationby recordingtheFirst,Second,Third,andFourth
DeclarationsofAnnexationtotheRestatedDeclarationasDocument Numbers 2453826,
2480710,2516323, and2516922 intheOfficeoftheGallatinCounty Clerk& Recorderon June
27,2013;May 12,2014; July 1,2015; and July8,2015;respectively.
WHEREAS, Article11 ("Use Restrictions"),Section11.14("Garbage and Refuse
Disposal")oftheRestatedDeclarationprohibitsany cans,bags,containers,orreceptaclesforthe
storingordisposaloftrash,garbage,refuse,rubble,debris,orrecyclablematerialsfrom being
stored,kept,placed,ormaintainedon any Lotwhere visiblefrom any streetexceptsolelyon a
daydesignatedforremovalofgarbage,rubbish,orrecyclablematerials.
WHEREAS, Declarantreservedthe rightunderArticle15 ("Amendment"), Section15.2
("DeclarantAmendment") oftheRestatedDeclarationto unilaterallyamend theRestated
Declarationforany purpose priortotheTurnover Date,providedthattheamendment has no
materialadverseeffectupon therightsof any Owner.
WHEREAS, on July1,2016,theDeclarantpolledLotOwners withinthe Subdivision
regardingthestorageofgarbage and recyclingcontainerson theAlley-sideofLotssituatedon
an Alley,andthemajorityofLotOwners votedinfavorofamending theRestatedDeclarationto
allowforsuch storage.
WHEREAS, Declarantdesirestoamend Article11,Section11.14oftheRestated
Declarationto reflectthemajoritypreferenceofLot Owners withintheSubdivisiontostore
garbageand recyclingcontainersontheAlley-sideofLotssituatedon an Alley.
WHEREAS, Declarantdesirestoamend ExhibitA oftheDesign Guidelinesto allow
variedwidthsofboardsintheSolidDesign Fence Plan.
NOW, THEREFORE, Declaranthereby amends theRestatedDeclarationandExhibitA
oftheDesign Guidelines,pursuanttoitsreservedrightsunderSection15.2oftheRestated
Declaration,asstatedbelow.

AMENDMENT OF RESTATED DECLARATION
1. Article11,Section11.14oftheRestatedDeclarationisdeletedinitsentiretyand hereby
replacedwiththefollowinglanguage:
11.14 Garbage and Refuse Disposal.
No Lotshallbeused ormaintainedasa dumping ground forrubbish.Trash,garbage
or otherwaste shallnot be kept,or disposed of,on any Lot except in sanitary
containers.All equipment forthestorageordisposalofsuch materialshallbe kept
inacleanand sanitarycondition.No cans,bags,containersor receptaclesforthe
storingordisposaloftrash,garbage,refuse,rubble,debris,orrecyclablematerials
shallbe stored,kept,placedormaintainedon any Lotwhere visiblefrom any street
except solelyon a day designatedforremoval of garbage,rubbish,or recyclable
materials,andonwhich daysonly such cans,bags,containers,and receptaclesmay
be placed in frontof a residenceand beside a streetfor removal, but shallbe
removed from view beforethe followingday. Notwithstandinganything inthe
precedingsentencetothe contrary,forany Lot situatedon an Alley,cans,bags,
containers,or receptaclesforthe storingor disposalof trash,garbage,refuse,
rubble,debris,or recyclablematerialsmay be stored,kept,placed,ormaintained
immediatelynextto thegarage doorontheAlley-sideofsuch Lot.
2. ExhibitA ofthe Design Guidelinesshallbe amended toallow lx6 and/orlx4
verticalboards intheSolidDesign Fence Plan.
3. Except as specificallyamended by thisAmendment, allofthetermsoftheRestated
Declarationshallremain infullforceand effect.
4. Intheeventofaconflictbetween thetermsofthisAmendment andthetermsofthe
RestatedDeclaration,thetermsofthisAmendment shallprevail.
