TO AMENDED AND RESTATED DECLARATION OF PROTECTIVE
COVENANTS, CONDITIONS AND RESTRICTIONS FOR NORTON RANCH
THIS THIRD DECLARATION OF ANNEXATION TO AMENDED AND RESTATED
DECLARATION OF PROTECTIVE COVENANTS, CONDITIONS AND RESTRICTIONS
FOR NORTON RANCH (this"Declaration ofAnnexation") ismade effectiveasofthedateof
itsrecordingintheOfficialRecords forGallatinCounty, Montana, by NORTON PROPERTIES
LLC, an Oregon limitedliabilitycompany, and NORTON RANCH HOMES, LLC, an Oregon
limitedliabilitycompany (individuallyand collectively,the "Declarant").
RECITALS:
A. Declarantcreateda residentialsubdivisionknown asNorton Ranch (the
"Subdivision") by recording(i)thatcertainAmended and RestatedDeclarationofProtective
Covenants, Conditions and RestrictionsforNorton Ranch on October 14,2011, as Document
Number 2399078 intheOfficialRecords ofGallatinCounty, Montana (the"Declaration");and
(ii)thatcertainplatofNorton EastRanch SubdivisionPhase 1 o n February 16,2011, as
Document Number 2382592 intheOfficialRecords ofGallatinCounty, Montana.
B. Declarantexpanded the Subdivisionby annexing additionalpropertyintothe
Subdivisionby recording(i)thatcertainFirstDeclarationofAnnexation toAmended and
RestatedDeclarationofProtectiveCovenants, Conditionsand RestrictionsforNorton Ranch
recordedon June 27,2013, asDocument No. 2453826 intheOfficialRecords ofGallatin
County, Montana; (ii)thatcertainSecond DeclarationofAnnexation to Amended and Restated
DeclarationofProtectiveCovenants, Conditions and RestrictionsforNorton Ranch recordedon
(11q p-- 7p19 ,as Document No. 19201 to inthe OfficialRecords ofGallatin
County, Montana; and (iii)thatcertainThird DeclarationofAnnexation to Amended and
RestatedDeclarationofProtectiveCovenants, Conditions and RestrictionsforNorton Ranch
recordedon 2 1,2olf ,asDocument No. 15\ f-e323 intheOfficial
Records ofGallatinCounty, Montana.

2382592 intheOfficialRecords ofGallatinCounty, Montana.
D. Declarantdesiresto annex the AdditionalPropertyintothe Subdivisionpursuant
toitsreservedrightsunder Section13.1oftheDeclaration,on terms and conditionsmore
particularlysetforthherein.
NOW, THEREFORE, Declaranthereby declaresthe followingpursuanttoitsreserved
rightsunder Section13.1oftheDeclaration:
1. Annexation.
1.1 The AdditionalPropertyishereby annexed intothe Subdivisionand shall
be held,conveyed,hypothecated,encumbered, used,occupied and improved subjecttotheterms
oftheDeclarationand thisDeclarationofAnnexation. The AdditionalPropertyshallbe
consideredpartofthe "Property"undertheDeclaration.
1.2 Each Lot comprising the AdditionalPropertyshallbe consideredaFuture
Development Lot.
2. Assessments.IntheeventthatattachedorstackedmultifamilyUnitsare
constructedon aFuture Development Lot,theBase Assessment, Reserve Account Assessment
or SpecialAssessment (exceptSpecialAssessments allocatedinthesame manner as Specific
Assessments) leviedagainstthatFuture Development Lotwillbe calculatedasfollows:Fifty
percent(50%) ofthe Base Assessment, Reserve Account Assessment or SpecialAssessment
(exceptSpecialAssessments allocatedinthesame manner as SpecificAssessments) levied
againstaLot with a singleUnit,timesthenumber ofUnitson thatFuture Development Lot.
3. Maintenance. By way ofclarification,the maintenance obligationsofeach Owner
ofaFuture Development Lotunder Section6.2ofthe Declarationincludes,withoutlimitation,
responsibilityformaintaining,repairingand replacingallbuildings,parking areas,driveaisles,
driveways,sidewalks,stairs,stoops,landings,lightfixtures,play structuresand other
improvements; maintaining(includingwatering)allgrass,treesand landscaping;and removing
snow and icefrom allsidewalks (on or adjacenttotheFuture Development Lot),stairs,stoops,
landings,parking areas,driveaislesand driveways.
4. Restrictionson Patiosand Balconies.Balconiesand patiosmust be kept inaclean
and orderlymanner, freefrom trash,debris,clutterand otheritemsthat,intheopinion ofthe
Association,detractfrom thegeneralappearance ofthebuildingand Subdivision.Balconiesand
patiosmay notbeused forstorage(including,but notlimitedto,thestorageofbicyclesor boxes)
orforhanging clothes.No signsor billboardsmay be displayedfrom balconiesor patios.No
grilling,cooking or any open flameispermittedon balconiesorpatios.

5. Miscellaneous.Intheevent ofaconflictbetween thetermsoftheDeclarationand
thetermsofthisDeclarationofAnnexation, thetermsofthisDeclarationAnnexation shall
prevailwith respecttothe AdditionalProperty.
