COVENANTS, CONDITIONS AND RESTRICTIONS FOR NORTON RANCH
THIS THIRD DECLARATION OF ANNEXATION TO AMENDED AND RESTATED
DECLARATION OF PROTECTIVE COVENANTS, CONDITIONS AND RESTRICTIONS
FOR NORTON RANCH (this"Declaration ofAnnexation") ismade effectiveasofthedateof
itsrecordinginthe OfficialRecords forGallatinCounty, Montana, by NORTON PROPERTIES
LLC, an Oregon limitedliabilitycompany, and NORTON RANCH HOMES, LLC, an Oregon
limitedliabilitycompany (individuallyand collectively,the"Declarant").
RECITALS:
A. Declarantcreateda residentialsubdivisionknown asNorton Ranch (the
"Subdivision") by recording(a)thatcertainAmended and RestatedDeclarationofProtective
Covenants,Conditionsand RestrictionsforNorton Ranch on October 14,2011, asDocument
Number 2399078 intheOfficialRecords ofGallatinCounty, Montana (the"Declaration");and
(b)thatcertainplatofNorton East Ranch SubdivisionPhase 1 on February 16,2011, as
Document Number 2382592 intheOfficialRecords ofGallatinCounty, Montana.
B. Declarantexpanded theSubdivisionby annexing additionalpropertyintothe
SubdivisioninthatcertainFirstDeclarationofAnnexation toAmended and RestatedDeclaration
ofProtectiveCovenants, Conditions and RestrictionsforNorton Ranch recordedon June 27,
2013, asDocument No. 2453826 inthe OfficialRecords ofGallatinCounty, Montana.
C. Declarantfurtherexpanded the Subdivisionby annexing additionalpropertyinto
the SubdivisioninthatcertainSecond DeclarationofAnnexation toAmended and Restated
DeclarationofProtectiveCovenants, Conditions and RestrictionsforNorton Ranch recordedon
May 12,2014, as Document No. 2480710 intheOfficialRecords ofGallatinCounty, Montana.
D. Norton PropertiesLLC isthe currentowner ofthe followingdescribedreal
property(the"Phase 3A Property"):
Lots 1 through 8,Block 1;Lots 1 through 12,Block 2;Lots I through 8,Block 3;Lots 1
through 12,Block 4;Lot 7,Block 5;Lots7 through 12,Block 7;Lot 1,Block 8;Park 3,
4,5and 6;and Open Space (OS) A, B and Cl, asshown on thefinalplatofNorton East

E. Declarantdesirestoannex thePhase 3A Propertyintothe Subdivisionpursuantto
itsreservedrightsunder Article13oftheDeclaration.
NOW, THEREFORE, Declaranthereby declaresthe followingpursuanttoitsreserved
rightsunder Article13oftheDeclaration:
1. Defined Terms. Any capitalizedterm notdefinedinthisDeclarationof
Annexation shallhave the meaning ascribedtosuch term inthe Declaration.
2. Annexation.
2.1 The Phase 3A Propertyishereby annexed intothe Subdivisionand shall
be held,conveyed,hypothecated,encumbered, used,occupied and improved subjecttothe terms
ofthe Declaration.The Phase 3A Propertyshallbe consideredpartofthe"Property" under the
Declarationand theplatforthePhase 3A Propertyshallbe considereda "Plat"underthe
Declaration.
2.2 Lots 1 through 8,Block 1;Lots I through 12,Block 2;Lots 1 through 8,
Block 3;Lots 1 through 12,Block 4;Lot 7,Block 5;Lots7 through 12,Block 7;and Lot 1,
Block 8withinthePhase 3A Propertyshalleachbe considereda"Lot" under the Declaration,
and eachowner ofthereofshallbe consideredan "Owner" under the Declaration.
2.3 Open Space (OS) A, B and Cl withinthe Phase 3A Propertyshalleach be
consideredpartofthe "Common Areas" under the Declaration.
2.4 Park 3B, 4,5and 6withinthe Phase 3A Propertyshalleachbe considered
partofthe"Parks" underthe Declaration.
3. Noxious Weed Control.The controlofnoxious weeds by the Associationon those
areasforwhich the Associationisresponsibleand thecontrolofnoxious weeds by individual
Owners on theirrespectiveLotsshallbe assetforthand specifiedundertheMontana Noxious
Weed Control Act (MCA 7-22-2101 through 7-22-2153) and the rulesand regulationsofthe
GallatinCounty Weed Department. The Associationisresponsibleforcontrolofstateand
county declarednoxious weeds intheCommon Areas (such as SubdivisionParks,Open Spaces,
community areas,trailsand roadways). Each Owner shallbe responsibleforthecontrolofthe
stateand county declarednoxious weeds on hisorherown Lot. Both unimproved and improved
Lotsshallbe managed fornoxious weeds. Intheeventan Owner does not controlthenoxious
weeds on hisorherown Lot,afterten(10)days'noticefrom the Association,theAssociation
may cause thenoxious weeds tobe controlled,inwhich casethecostand expense associated
withsuchweed management shallbe assessedagainst,and alien on,thatLot.
4. Miscellaneous. Intheeventofaconflictbetween thetermsofthe Declaration
and theterms ofthisDeclarationofAnnexation, the terms ofthisDeclarationAnnexation shall
prevailwith respecttothePhase 3A Property.
