The following are my responses to your questions.
1. Question 1 does not seem to be a question but rather an informative statement.
2. Question 2‐ Thank you for the clarification. The extra MCA citation can stay. The BMC has can be provided
after the citation and the submitted plat has will be provided. Please make this change.
3. Question 3‐ Thank you for the clarification‐ The provided certificate will work.
4. Question 4‐ Yes this easement can be on the plat but the same operative language that is in the Citys drainage
easement template must be included on the plat.
5. Question 5‐ No, this is referring to the easement for the Park 5B detention pond outlet pipe and wetland
outflow pipe that extend offsite to the west onto the parcel labeled UNPLATTED, Aajker Creek Properties, LLC.,
2346749 on Sheet 1 of the submitted plat. Attached is a sheet from the infrastructure plans showing the pipes
and their discharge location onto the adjacent property.
6. Question 6‐ There are multiple easements within Phase 5. These need to be listed on the conditions of approval
sheet. Any documents that are recorded or will be recorded with this plat that are associated with this plat need
to be listed on the conditions of approval sheet. Examples include separate recorded easements, property
owners association documents, and maintenance agreements.
While reviewing your questions, I do have a few questions for you.
1. Why is there a general notes section on both Sheet 3 and Sheet 4? Some of the notes included on each sheet are
the same.
2. Why is the certificate for ARM 24.183.1107(4) on both Sheet 3 and Sheet 4 with one having a signature block for
the owner and the other without a signature block?

Cody,
I was going through the comments from you and planning on this, and had a couple questions concerning the
certificates.
1. On comments 21, 45 and 47, it appears the Director of Public Works certificate was split into 2 new
certificates. It seems like it was more efficient the previous way, but will make the change accordingly.
2. For Comment 22, the DEQ requested a further citation on the Exclusion from DEQ Review certificate which we
added about 3 years ago, and we made Chris Saunders aware of it. The DEQ wanted this for approving the MFE
application where a copy of the plat is a part of it. We have had this certificate the same way since then. I
thought Chris would have brought this up by now to modify the code.
3. On Comment 23 about the Conditions of Approval statements, the certificate we prepared about 3 years ago
was cut and pasted directly out of the ARMs. It has all the statements listed in the BMC, but straight out of the
ARMs. This certificate has been the same on all of our plats since then.
4. On Comment 25, can this easement just be shown on the plat? This would seem to be more efficient.
5. On Comment 34, is this referring to the easement cited in comment 25?
6. On comments 37 and 38, it is vague on what the code means by list all associated recorded documents and
recorded document numbers, and list easements, including easements for water user facilities.
