Greg,
The US Army Corps concurred with our findings that the expanded wetland and excavated ditch are non‐
jurisdictional wetlands. We will not need to appeal the findings. You can provide the information to the City
of Bozeman. The Preservation wetland including the 25‐foot buffer must still be protected under the
Covenant of Dedication. No wetland impacts are allowed within this area.
Please let me know if you have further questions. Kevin received this email from Tim McNew. Your plat
approval should be able to progress to construction. Good news.
