I own property and live across the street from the horribly inappropriate, unethical and illegal proposed zoning change on N. 8th Ave. I would like the commisoiners to know that I am being discriminated against on the basis of my disability concerning the proposed N. 8th zoning change. I would like the official record to reflect the fact that I have been unfairly excluded from the democratic process based on discrimination due to my disability by the City of Bozeman. I was supposed to be included on the list of Adjoining Property Owners and I was not due to discrimination by the City of Bozeman Planning Department. This willful exclusion was based on my disability as well as my comments that the planning department did not give to the City Commission and my past dealings with the Planning Department trying to unsuccessfully have my own projects approved. All of my other neighbors have been on the Adjoining Property Owner's list since 2/28/23. I was excluded from the list, which was and is a violation of my property rights as well as discriminatory towards my disability. I requested multiple times to be included on that list and was ignored by the Planning Department three separate times. I was only recently added to the list on 6/2/23 after threatening a lawsuit. I am currently in the process of filing a complaint against the City of Bozeman with the Montana Human Rights Bureau for discriminating against me and violating my right to be included. This zoning change must be denied on the basis that my property rights are being violated by the City of Bozeman. As a person with a disability, I have heard so much talk from the City of Bozeman about Diversity, equity and inclusion. Yet the reality I have experienced living in bozeman the last 28 years has been the complete opposite of Diversity, equity and inclusion. I am diverse due to my disability, yet the City Planning Department has purposefully gone out of their way to not treat me equitably and time and time again refuses to include me and give me the same property rights as my neighbors without a disability. By refusing to include me on the Adjoining property owners list, theCity has invalidated this whole process and rendered it completelyundemocratic, unethical, illegal and unamerican! I have the samerights as everyone else. This zoning change violates my propertyrights and my right to be included and can not be allowed to proceed. By leaving me off the list, I was denied the right to be contacted bymy neighbors or contact my neighbors to organize. This whole processand outcome would have been different had I been included on that listat the correct time, just like everyone else. Now the City has already held a meeting without me and everyone whohas a vote is now biased because I was denied the opportunity tospeak. The planning department succeeded in excluding me because ofmy disability and now everything is tainted and biased and this zoningchange must be denied on the basis that it attempted to exclude me,the one property owner who would lose the most financially if thiszoning change was approved. Gee, what a coincidence, the planning department "accidentally" leftthe owner with the most financially to lose, who has a past history ofbutting heads with the planning department, and who has a history oforganizing neighbors off the list of Adjoining property owners.Denying me an equitable right to be included was no accident, that waspure discrimination and it can not be allowed to occur in the City ofBozeman Planning process. You must not allow people with disabilities to be unequitably excludedfrom the planning process that directly affects the value of theirhome, their greatest and only asset keeping them from living on thestreet. This zoning change will be completely unfair. It is solely for theprivate wealth gain of two individual property owners and it comes atthe expense of the neighboring property owners. Studies have proven that this kind of change will devalue the homesacross the street, anyone from the planning department who claimsotherwise is a liar. Yes, I am calling b.s on the planning departmentreports. The reports are ridiculously biased, so biased they arecompletely ignoring the rights of adjacent property owners. Aninvestigation into how much money the developer is kicking back tothe head of the planning department is absolutely necessary to protectthe rights of Bozeman's citizens. I've lived in the neighborhood for20 years and I completely disagree with the ridiculously biasedspeculation that is nothing but opinion and conjecture and containszero facts, figures or references to back up the absolutely falseassertions made by the biased report. How would the writer of thisjoke report like this change across the street from his or her home,would the report be written so biased and untruthful as it is now? The planning department doesn't think this change would affectproperty values. Are you kidding me, is that for real? They claim it is a "robust market" so the change will not matter. Wrong!!!! I'm sorry, planning department report writing person, you may have more education than me, but you do not have a crystal ball. No one can sayfor sure how much this change would devalue my home. I really, reallydon't appreciate the planning department gambling with the value of myhome so that they can make their developer buddies more money. Andjust completely lying about what planning professionals know thatstudies have proven these types of changes lower the value of thehouse across the street. The devo;lper can make plenty of money andbuild tons of affordable housing with the current R-4 zoning. TheR-5 change takes away all the green space and parking and makes thesurrounding homes less valuable. If this change is approved, I will be forced to sue the City ofBozeman for discriminating against me, leaving off the adjoiningproperty owners list and unfairly altering the outcome of the vote.This zoning change will destroy the value of my home, ruin myretirement, financially destroy me and force me out of my home. Thisis not right to exclude me because of my disability and I will sue theCity of Bozeman seeking damages if this change is approved.
