Dear Parker Lange,
Northwestern Energy is willing and able to provide natural gas and electric service to the South 40
Subdivision which includes fifty two (52) townhomes, two hundred and nine (209) build to rent homes,
sixty (60) B2R townhomes and, eight (8) commercial buildings. These services can be provided in
accordance with applicable Montana Public Services rules and regulations and the current Northwestern
Energy tariff schedule. Please note that the nearest natural gas is at the intersection of S 19th Ave and
Graft St. The nearest electric is at the intersection of S 19th Ave and Graft St.
Northwestern Energy shall determine the locations of all transformers, underground lines and equipment
to provide for maintenance and installation. These facilities shall be located on front lot lines in a
minimum 10’ wide utility easement.
Please call or email me if you have any questions or concerns at (406) 223-6498. Also, we require
having a copy of the approved plat of this proposed area prior to providing a cost to bring in these
services. If installation is required prior to approval of the plat, it will be your responsibility to keep us
informed of any changes which would alter our utility design and installation. To request a cost estimate
we would also require a signed application for new service along with an electronic layout of the
subdivision.

RE: South 40 development
Recently you approached CenturyLink about providing a “Will Serve” letter to serve South 40 at the
intersection of S 19th Ave and Graf St in Bozeman, MT. CenturyLink appreciates the opportunity to
provide Providence Development with its future communications needs.
In response to the request for a commitment to serve, CenturyLink will work with Providence
Development to determine what the construction needs will be. Upon such determination, CenturyLink
will undertake an analysis of the construction required and the cost to complete that construction. It is
only at that point and given the prevailing Tariffs that CenturyLink will make a final determination
regarding whether to provide service. We do have facilities within the area of your project, and we do
have the capacity to provide phone and internet services.
As you may or may not know, many of the telecommunications services provided by CenturyLink are
regulated and the service you request will be provided for under the tariffs on file with the Montana
Public Service Commission.

Dear Mr. Lange,
Your new single family housing project - South 40, located at W Graf Street and S 15th Ave,
Bozeman, MT, 59715 is in Charter Communication’s footprint for video, internet and voice
services. Absent of any unforeseeable adverse circumstances or conditions including any force
majeure events outside of Charter’s control, and upon completion of a mutually agreed upon
Service Agreement, Charter Communications will be able to extend its plant to provide service to
your project.
We will need to work with your representatives on an Access Agreement, for your project. We
will need this Agreement executed prior to Charter beginning our construction phase for the
project.
Not a Binding Obligation. THIS LETTER OF INTENT DOES NOT CONSTITUTE OR
CREATE, AND SHALL NOT BE DEEMED TO CONSTITUTE OR CREATE, ANY LEGALLY
BINDING OR ENFORCEABLE OBLIGATION ON THE PART OF EITHER PARTY TO THIS
LETTER OF INTENT. NO SUCH OBLIGATION SHALL BE CREATED, EXCEPT BY THE
EXECUTION AND DELIVERY OF THE ACCESS AGREEMENT CONTAINING SUCH
TERMS AND CONDITIONS OF THE PROPOSED TRANSACTIONS AS SHALL BE
AGREED UPON BY THE PARTIES, AND THEN ONLY IN ACCORDANCE WITH THE
TERMS AND CONDITIONS OF SUCH ACCESS AGREEMENT.

Mr. Lange,
Bozeman Fiber, dba Yellowstone fiber will be please to service you at South 40 with High-speed
Internet. We can routinely provide from 250/250 Mbps to 10 Gig service and if necessary 100 Gig service
to your site at the SE corner of Graf and 19th street. We would be able to service build to rent,
townhomes and commercial units. Please advise in the future as you are ready for conduit installation
(normally with Northwest Energy’s installation of power).
