RE: South 40 Subdivision
Dear Christine Pearcy,
Montana Fish, Wildlife & Parks (FWP) appreciates the opportunity to comment on the South 40
Subdivision.
The proposed South 40 subdivision surrounds a potentially jurisdictional perennial stream that parallels
South 19th Avenue. Should the Gallatin Conservation District determine that it is in fact a jurisdictional
waterbody, 310 permits would be required to alter the bed, banks, or riparian area immediately
adjacent to the stream. FWP subdivision guidelines recommend a minimum stream setback of 200 feet
that includes 150 feet of vegetation buffer plus an additional 50 feet of building setback from the
stream.The nearby stream conveys water to downstream habitats that support popular recreational
fisheries in the Gallatin and East Gallatin rivers, so it is important to maintain, or even improve,the
condition of the stream within the proposed development.Therefore, FWP recommends not only a
building setback, but also maintaining an intact riparian zone free of disturbance (e.g., trails) along the
stream within the development to help protect its integrity as well as downstream habitats and
organisms it supports.
