(' 1] i My name is Scott Bieluch. I own property located at 805 W. Lamme St. Bozeman, MT 59715. I am writing to officially protest the proposed zoning change for N. 8th Ave. in Bozeman, MT. I have been a resident of the neighborhood for over twenty years and I believe that this change will have a devastating impact on my prope1ty value and the existing residential character of the neighborhood. The current zoning for N. 8th ave, is R-4 and this suits the neighborhood perfectly. The proposed zoning change to R-5 is completely inappropriate and would devastate the property values of existing homeowners in the neighborhood. Many homeowners have their entire savings invested in their home and this developer is seeking to devalue all of the smrounding prope1ties and cause devastating economic impact to the adjacent property owners. This change will have a devastating impact on my property value for several reasons. First, this change would increase traffic, noise and crime levels in the area. Second, this change will decrease the amount of green space in the neighborhood. Third, this development would change the character of the neighborhood, from a quiet residential area, to a busy commercial place. This will bring commercial crimes like loitering, vandalism, property theft, rape etc to a now quiet residential area. I am extremely concerned that this proposed zoning change will make my house less desirable and therefore this development will reduce the value ofmy prope1ty. I urge you not to financially destroy me and not to allow this ridiculously inappropriate zoning change. The current zoning for N. 8th Ave has been in place for many, many years and has helped to create a quiet, peaceful neighborhood. The proposed zoning change would destroy the residential character of the neighborhood and make it impossible for families and children to live hear and peacefully enjoy the quiet residential neighborhood. I urge you, I beg you reject this zoning change and keep the zoning as it is, or you will be forcing me out ofmy home of twenty plus years. I believe this zoning change will devastate my property value for several reasons. Commercial development will bring traffic and crime without bringing any additional resources to the City. This proposed zoning change has zero benefits to the public and is proposed solely to increase the profits of an out of state developer at the expense of long time local citizens. I urge you to reject this evil devastating change that will destroy the neighborhood and cause existing residents to lose their life's savings. This proposed zoning change is a clear violation of the City's comprehensive plan., which states that the City should "preserve and enhance the residential character of neighborhoods" The proposed zoning change will also violate the City's noise ordinance, which states that "no person shall cause or permit any noise which is umeasonably loud, disturbing, or offensive to the comf01t, repose or peace of others" This zoning change would cause trees to be removed, and the loss of shade for the neighborhood. The streets are not even wide enough to accommodate the emergency access that this change would require. There are no public contributions or benefits with this zoning change, it would 100 percent be a change purely for private wealth gain of an out of state developer who care nothing about the quality of life of the people who built the neighborhood. There is no park space included in this zoning change, there is no funding for schools or the extra police that will be required by this change. In addition, this proposed zoning change does not include enough provisions for affordable housing, these units will be sold to wealthy out of state investors, not local working people, like the area currently houses. This developer purposefully violated my property rights and did not notify me, an adjacent property owner, of the proposed change. This was a clear attempt by an extremely unethical developer to sneak this zoning change through without the residents if the neighborhood being aware of what was being attempted. The developer is a horrible prope1ty owner and does not shovel the sidewalk, mow the lawn or maintain the prope1ty at all. This developer is a blight on the neighborhood and should go back to wherever they came from. The failure to notify me of this proposed zoning change should have been cause enough by itself to deny this terrible zoning change. This is only one of many, many City of Bozeman ordinances that this developer constantly violates as they have zero concern for the safety or quality of life of the existing neighborhood residents. This zoning change would drastically lower my property value and destroy everything that I have worked for the last twenty years to build. The City Commission has a duty to ensure that all property owners are treated fairly and that their propetty rights are protected. This change will drastically lower my prope1ty value and ruin my retirement. This change would bring commercial traffic and commercial problems to my now quiet residential neighborhood. This is a terrible, horrible, neighborhood destroying change that will pretty much rnin my life and force me out ofmy home of twenty plus years. This developer does not respect the property rights of his neighbors. I urge you to deny this absolutely ridiculous zoning change. This change would be highly unethical, illegal and immoral. This change would bring increased crime and no additional resources to help with the problems that this zoning change will create for regular working class residents of the neighborhood. This developer has already violated my property rights by not notifying me of this proposed change, as was legally required and ethically 100 percent necessary. This change would allow the developer to block the sun from ever shining on my tiny little house again. This change would destroy the residential character of the neighborhood and result in a massively reduced quality oflife for the existing residents of the neighborhood. This is a prime example of change that the City residents do not want, this is out if state money forcing long time local residents out of their homes. Citizens have rights against these neighborhood destroying developers, please enforce my rights and stop this disastrous proposed change. Please don't add to the housing problems already occurring in the City by gentrifying every single little neighborhood in the downtown core area. Zoning changes like this one are forcing long time local residents from their homes only to enhance the wealth of out of state milionaire developers. Parking in this neighborhood has been a nightmare for the last twenty years and this change would make it impossible for me to ever park in front of my home again. The neighborhood is already filled with high school kids who park here because it is right outside the permit zone. In addition, there are already commercial business in the area who do not provide enough parking and I already have people who are parking at my house to patronize the businesses close to the neighborhood. This change would make an already bad parking situation way, way worse and leave me no opportunities to park in front ofmy home, due to this new commercial development across the street from my small residential home. This zoning change would bring absolutely zero public benefit. The cunent zoning works perfectly for the neighborhood and all of the residents are very happy with it as it is now. Please, please do not approve this zoning change, if you do, keep in mind that you are forcing me out of my home of over twenty years by changing the residential character of the neighborhood leaving me no where to park. If you vote to approve this I hope you fell good about yourselves for destroying the lives of long time locals whose interests that you are supposed to be representing ~r con~;/;/ Scott Bieluch 805 W.
