Application # 22039:
My name is Alix Byrd and my family of 5 live at 3339 Lolo Way. I wanted to reach out again andaddress my concerns for the special use permit for application 22039. Your response to our last
inquiry about the gas station was that gas stations are safe and don’t pose any risk to those who livenear them. Did you know that there is a non profit dedicated to helping neighborhoods fight poorlyplanned gas stations for that exact reason. There isn’t enough research to concretely say that they aresafe. The fumes tell a different story and being that our home will be within 500ft of this gas station
I’m extremely worried about it and the potential health impacts on my family. We are incrediblylucky to have found a home in Bozeman with a yard for our family of 5 and our 2 dogs. We alsocan’t afford to go anywhere else and with the gas station going in across the street you are tankingour ability to ever be able to sell our home for what it’s worth. We are begging you to hear us. We
know you all are busy, but this is our everyday life and the health and safety of our family you areimpacting. If you want to read more about the health concerns, I am talking about you can look herehttps://ceds.org/gasstation/ or on the World Health Organizations website. Bozeman is growing at a
rate that is alarming and we hope that you will take the time and really assess the needs for a gas
station in the middle of our neighborhood. A neighborhood of middle-class citizens who can’t affordto fight this battle other than to beg you to please prove us wrong and deny the special use permit.The fact that we even have to say this and voice our strong opposition is so disheartening. Especiallywith 4 full-service gas stations all within 1-2 miles of this one.
To extend the B-2 zone and approve a special use permit of a 24-hour convenience store across thestreet from a single-family home zoning district makes no sense and should be reconsidered. B2 =
community Business District. The intent of B2 is to provide a range of mutually supportive retailand service functions, not a 12-pump gas station. Any retail would be a better fit than this choice.
The additional traffic to this already busy area, with the addition of fuel pollution, 24-hour lightintrusions, 24-hour access to vehicles and 24 hours noise addition to the neighborhood will beunwarranted and unwanted. Again, not supportive of the area around the proposed site and should bereconsidered.
The addition of 24-hour traffic and the sound that it will bring to a single-family home isunnecessary. The city development and planning should be pushing traffic towards 19th not pushing
traffic into residential areas. This area is zoned for mutually supportive retail and services, not a 24-hour gas station that will add traffic, light, noise, and pollution to the abutting areas of a single-family housing district.
I believe you need to take into consideration that the special permit does not meet the requirementsof:
Sec. 38.230.120. - Special use permit.
1. …… adequate to properly relate such use with the land and uses in the vicinity.
2. That the proposed use will have no material adverse effect upon the abutting property. Persons
objecting to the recommendations of review bodies carry the burden of proof
3. That any additional conditions stated in the approval are deemed necessary to protect the
public health, safety, and general welfare. Such conditions may include, but are not limited
to: SECTIONS D,E, and G specifically mentioned in my comments above.
This area has elementary school, middle school and high school kids crossing the street all the timeon the way to school and pushing traffic into this area is not supportive of the Bozeman community. There are enough gas stations in this area and approval to add another one is unnecessary for the cityand community that you are supposed to be protecting and listening to.
Also, if the city will not hear the comments and a gas station is going to go there no matter how
many times we comment or disagree with it. Then the city should at a minimum be considering thefollowing concerns: hours of operation and not allow operation past 10pm or even earlier. Thelight heights should not exceed 20’ and should be off by 10pm. Environmental safety protections toreduce the release of benzine into the environment and directly into our homes. And the light
brightness must meet the requirements of the neighborhood. There is no location in the city ofBozeman that has a gas station directly bordering single family dwellings especially at the size ofthis proposal, this should not be approved and should have never even been considered.
