This proposal does not meet Bozeman’s city requirements for safe access so close to theintersection of Baxter and Davis, as required by BMC 38.400.090. For this reason,Application # 22039 and the special permit required under BMC 38.230.120 should bedenied.
BMC 38.220.080 Traffic Generation – The traffic study does not consider future increased traffic that will be addedto Baxter Lane due to the present and increased building West of Ferguson. Southbound Davis St may be consideredan arterial street through town for residents, but Northbound Davis St is a narrow single lane street lined withresidential condos. Traffic entering and exiting a gas station so close to the intersection can create an unnecessaryhazard for cars and middle school students walking and riding their bikes to and from school.
Listed below are the numerous gas stations located nearby, so the need for an additional one at the proposed location isquestionable.
While Davis Street is an arterial street, it is also dissecting a growing residential neighborhood that needs “neighborhood”businesses, not another gas station. A gym, daycare, dentist, doctor’s office, coffee shop, café/restaurant, petstore/grooming/boarding facility, brewery, candy store, specialty grocery store, barber/hair salon, bakery/ice cream shop. Noneighborhood needs a gas station with bright lights and heavy traffic! Bozeman does not have gas stations in any otherneighborhoods, and this is not the place to test one out.
