Sheryl,
Thank you for your public comment. It will be included in the record and available to the reviewers,
applicant and decision makers. I have also forwarded your comment to the Engineering Department
and the project engineer to ask for follow up. I know they are doing some more research and this
will be required to be resolved prior to site plan approval. The applicants drawings shows Ivan Drive
as a public right of way with an access and utility easement over it. Initial research from our
engineering team shows this may be an inaccurate representation as you stated.

Good afternoon Lynn,My name is Sheryl Nichols, and I own a townhouse located at 501 Ivan Drive in theHomestead Townhomes area, which is directly north of the proposed North 3rd Apartmentproject. Several other Homestead residents have voiced concerns about the new apartments using IvanDrive as an "access connection". The Transportation Impact Analysis document specifically mentions the following :
Project Proposal.
The proposed
North 3rd Apartments
project would include the development of seven mid-
rise buildings with a total of 216 multifamily dwelling units. The primary access to the
site would be provided
by two proposed driveways on N 3rd Avenue. Other access connections to the site
are proposed to be
provided via N 4th Avenue on the south side of the site and
via Ivan Avenue on the north side of the site.
The buildout of the project is anticipated in 2025.
I've bolded the wording that concerns us.
Based upon my conversations with individuals at the City of Bozeman street
department (Christine and Kellen), Ivan Drive is listed as a "private street, not a cityright of way".
Kellen suggested I contact you for further clarification as it would seem that since
Homestead Townhomes pays to maintain Ivan Drive, we should be able to restrict
access.
Can you help clarify whether that is true or not?
Ivan Drive will not be able to handle the increased volume of traffic that 216 newapartments will bring.
