GRANT OF MUTUAL ACCESS EASEMENT
This Grant of Mutual Access Easement is made by Sutev, LLC, a Nlonrtana limited liability
company, GRANTOR, with a mailing address of 2000 Holmes Avenue. Butte, MT 59701-3553,
owner of the following described property:
S 1/2. SW 1/4, SW 1/4, SW 1/4, Section 35, Township I South, Range 5 East of P.M.M., and
being a 5.036 acre tract as shown on Certificate of Survey No. 2970, according to the plat
thereof; on file and of record in the office of the Clerk and Recorder, Gallatin County,
Montana.
Said easement being granted to DL Phase One, LLC, a Monrtana limited liability company,
GRANTEE, with a mailing address of 122 Kundert Lane, Bozeman, NIT 59718-7868, owner of
the following described property:
N 1/2, SW 1/4, SW 1/4, SW 1/4; and S 1/2, NW 1/4, SW 1/4, SW 1/4, Section 3 5, Township
I South, Range 5 East of P.I1i.M., being 10 acres more or less.
WHEREAS, the GRANTOR has determined that it is in their best interest to establish a mutual
access easement for the development of the both properties described above;
NOW, THEREFORE, a mutual access easement for a common driveway and ingress and egress
is hereby established. The location and dimensions of said easement is shown on the attached
Exhibit A which by this reference is made a part of this document.
THAT this common mutual access easement shall be a perpetual easement and shall be superior
to and paramount to the rights of any of the subsequent owners of said properties and the
respective servient estates so created. The GRANTOR further states that this easement is a
covenant that shall run with the land, and shall be for the benefit of and inure to the GRANTEE._
their successors and assigns, their agents;employees, tenants, and guests of tenants forever.
THAT the subsequent owners and their heirs and assigns shall be responsible for the
maintenance and repair of their respective portions of the shared access, including the street
approach and public sidewalk.
THAT each subsequent owner and their heirs and assigns shall hold the other party harmless

from any liability resulting from the use of the mutual access for ingress and egress to their
respective properties.
THAT the mutual access easement shall remain free and clear at all times from all
encumbrances. The GRANTOR hereby warrants that it has a lawful right to grant an easement
on the property described.
