Hey Eric-
Long story short- we couldn’t find the 37’ easement to read the language – however, the final plat does include a
certificate of dedication that includes language allowing public access, so based on that cert. the public access is taken
care of. No additional public access easement will need to be filed for the Upland Way condos development. Please
submit this correspondence into PDox when you resubmit and I will resolve the change mark.

Attached above is the plat for Baxter Square Subdivision that we have seen. This plat calls out a 37’ wide private road
and public utility easement. Is there something that we aren’t seeing that you are?

The applicant is proposing to provide access to the site through Renne Way private streets. The applicant must
provide a public access easement through the Renne Way private street to accommodate site traffic and access.
The City Standard Public Access Easement Template is uploaded as part of this transmittal.
WHEN THE CITY APPROVED RENNE WAY THEY CITY SHOULD HAVE REQUIRED A PUBLIC ACCESS EASEMENT.
ONLY A PRIVATE ACCESS AND PUBLIC UTILITY EASMENT WAS REQUIRED. THIS LOT IS LONG AND NARROW AND
BECAUSE THE CITY DID NOT REQUIRE A PUBLIC ACCESS EASEMENT ON RENNE WAY THE ONLY HAS PUBLIC
ACCESS IS VIA BAXTER. WE PROPSOED AN EMERGENCY ACCESS ONLY ONTO RNNE WAY.
ENGINEERING RESPONSE: The final plat includes a certificate of dedication that allows public use of the private
street. Therefore, no public access easement will be needed. The applicant is directed to reference this
correspondence in your next project submittal in order to have the above noted changemark resolved.
