The existing CILWR credit associated with the property is sufficient to cover the development's annual demand, no
CILWR fee is required. Below is a summary of the existing credit and proposed annual demand.
Existing Credit: 14.61 Acre-feet (AF)
Upland Way Residential Demand: 5.208AF (42 units @ 0.124AF/unit)
Upland Way Landscaping Demand: 1.23AF (per Sheet L2.1)
Remaining Credit: 14.61AF—5.208AF-1.23AF= 8.172AF

Erik,
Based on the information presented no CILWR fee is required for the project. I do still need the irrigation demands for
my records but don't anticipate a demand high enough to warrant payment. Either you can send me the landscaping
sheet(s) with the demands noted or just let me know when Planning has logged the site plan submittal and I'll pull the
sheets from the file.This email will satisfy the submittal requirements.
Just a heads up our Water Adequacy Code (BMC 38.410.130) has since been updated from Brian's response. Our CILWR
fee is now triggered for demand changes in excess of 0.25AF rather than 1AF.

Attached above is the Cash in Lieu of Water of Rights for Upland Way Condominiums. Also included is previous
correspondence between Brian Heston and the previous Engineer.
We recently submitted this to Bozeman Planning for review with our Site Plan submittal. Danielle Garber sent me an
email stating that I need your approval before they can start the review process.According to Bill Pratt, we are on an
extreme time crunch to resubmit via cloud link before everything transitions this Thursday the 4th and will need to utilize
the new software. Please review and let me know if you have any questions as soon as possible.Thank you.
