BACKGROUND:With the 2020 Census the Bozeman Urban Area crossed the population threshold of 50,000. Urban areas with a population that exceeds 50,000 are required to from a Metropolitan Planning Organization (MPO). The Montana Department of Transportation (MDT) is currently leading the designation process in close coordination with local entities. Per federal guidelines, the designation process is required to be complete by the end of December 2023. Once the MPO has been officially designated by the governor, the local entities will begin the MPO Formation process including the establishment of the MPO committees. As was discussed by this Committee at a previous meeting, by definition the MPO committees and the Transportation Coordinating Committee (TCC) can't coexist. Therefore the dissolution of the TCC is required to enable the designation of the MPO. The TCC was formed via Memorandum of Agreement (MOA) between the Montana Department of Transportation, the City of Bozeman, Gallatin County, the City of Bozeman Department of Planning and Community Development, and the Gallatin County Planning Board. The MOA was signed in 1996 and amended in 2000 and again in 2009. Section VI Termination of Agreements states "A signatory party may terminate its interest and obligations under this Agreement by giving at least sixty (60) days notice in writing to the other parties." Therefore, dissolution of the TCC is not official until sixty (60) days after the final written notification of termination is received. Since the process of receiving written notice from all five (5) signatories is likely to take some time, the chair plans formally notify the TCC members of dissolution at the July 26, 2023. Additionally, if the dissolution is official sooner than required, it will create the potential to accelerate the MPO establishment process. 10 The chair proposes that the current members continue meet, at the remaining 2023 scheduled meeting times, not as the TCC, instead to provide a public forum for updates on the MPO process. The meetings would also serve to continue coordination between member organizations and serve to transition to the MPO committees.
