Per the Code, the easement “must always be provided unless written confirmation is submitted to the community
development department from all utility companies providing service indicating that front setback easements are not
needed.”
You’ll need written confirmation from the affected utility companies that they don’t need the easement to run their
utility lines through to serve the area not just the site.

· BMC 38.410.060 (B) (2) Easements - The applicant must provide a ten foot utility easement (power, gas,
communication, etc.) along the developments property frontages prior to Site Plan approval. The applicant may
contact the Engineering Department to receive a copy of a utility easement template.
Our civil engineer was not sure why that easement is necessary. He was saying that typically private utility easements
are already taken care of as part of the platting process for a development. We don’t need a private utility easement for
our proposed building design which led us to think it would not be needed. Is there a way we could communicate that to
remove the requirement, or what would be the best way to handle that?

Thanks for highlighting the area of question. As discussed, with your plan to bring power to the proposed project from
the snowload building, we do not foresee us needing to run utilities within the highlighted areas. So a 10’ setback

I am the engineer at NWE for this project. I would like to discuss this project as your time allows. I’m not seeing your
direct phone number, but only your email. A couple of things:
· I am no expert on easements so I’ll have to glean any information from you and review with my peers to get the
correct answers
· I’m not sure where this new drive-thru banking building resides “across the alleyway”
· It appears that there is a 3PH 300kva padmount transformer towards the NW side of the building

so, to avoid costs incurred to Stockman Bank for repair and/or replacement, prudent utility locating and avoidance will be needed to ensure existing facilities are not
