Do not click links or open attachments unless you recognize the sender and know the content is safe. Dear City of Bozeman Zoning Board, My name is Scott Bieluch. I have lived at 805 W. Lamme since 2003. I am writing to express my opposition to the proposed zoning change on N 8th Ave in Bozeman, MT. I am a property owner of 20 years on W Lamme St, which is located across the street from the property that is the subject of the change. I was not notified of the proposed zoning change by mail, as required by the Bozeman Zoning Ordinance.!!! This was a highly unethical and illegal deliberate action by the property developer. I only learned of the change a few days before the 4/4/23 City Commission meeting, when I saw a sign on the property. This did not allow me a fair opportunity to research the project or oppose it or attend the meeting and denied me of my rights to voice my opinion. I was illegally silenced by an unethical, criminal developer and the only way to make it right is to deny this proposed zoning change. I will take legal action to protect my rights if necessary. The failure to notify me of the proposed zoning change is a violation of my rights. This was illegal, unethical, dishonest and completely unfair to me. I am a property owner and long time tax payer who is directly affected by the change, and I have a right to be informed of the change and to have a say in the decision-making process. These are my rights as a citizen of Bozeman. Please City Commissioners, protect my rights, do not take them away!! I was purposefully denied this right by the developer of this property. I formally request that you enforce my rights and immediately deny this zoning change due to failure by the developer to notify me, an adjoining property owner. It was legally required to notify me of these proposed changes, the developer failing to do so is cause to deny this proposed zoning change. This is only one of many City Ordinances that this property owner / developer constantly flouts as they have zero concern for the safety of the neighborhood residents. The failure to notify me of the proposed zoning change is only one of many, many reasons why the zoning change should be denied. The zoning board has a duty to ensure that all property owners are treated fairly and that their rights are protected. This change will drastically lower my property value and bring commercial traffic and commercial problems to my now quiet residential neighborhood. I will take legal action if necessary to enforce my right to be notified and my right to speak in opposition to this horrible, neighborhood destroying change. By failing to notify me of the proposed zoning change, the developer has shown that they do not respect the rights of property owners. I urge the zoning board to deny the proposed zoning change.
