Thank you for bringing this important issue to our attention. Municipal Court judges, like the members of the City Commission, are elected officials and not City employees. Under both 3-6-203, MCA, and Sec. 22.01.090,BMC, only the Bozeman City Commission can establish the salary for Municipal Court judges. The Commission has not authorized the Municipal Court judges to receive director benefits. Respectfully,the Commission disagrees with the allegations the City Manager's decision to disallow director benefits for the judges violates Resolution 5169 or Montana law. The Bozeman City Commission will consider a resolution establishing the salary for the municipal court judges for fiscal year 2023 at its April 11, 2023 meeting. In doing so, the Commission will take into consideration the additional duties required by state law for a chief judge of a municipal court. A y, Siis L.
